공영방송의 조직에 관한 헌법적 요청 -독일 공영방송의 감독기구(Aufsichtsgremien)를 중심으로-
Constitutional Requirements for the Internal Organization of Public Broadcasting: With Special Consideration of Supervisory Bodies in Germany

2024년 독일의 공영방송은 근본적인 개혁을 앞두고 있다. 연방주방송위원회는 공영방송의 장기적인 발전을 위해 2023년 3월 ‘공영방송의 미래 발전을 위한 위원회’를 발족하여, 2024년 1월 ‘공영방송 미래 발전을 위한 보고서’가 발표되었다. 또한 2024년 9월 26일 연방주방송위원회는 ‘공영방송 개혁을 위한 주간협약’ 입법안을 제안하여, 현재 관계기관의 의견청취절차가 진행 중이다. 그 내용에는 외부적 감독기구로서 미디어협의회(Medienrat)를 신설하는 내용이 포함되어 기존에 주로 내부적 자율규제로 대표되는 독일 공영방송의 감독구조에도 변화를 예고한다. 이하에서는 방송의 자유에 대한 독일 연방헌법재판소 결정을 통해 구체화된 공영방송에 대한 주요 헌법적 요청을 개관하고(Ⅱ), 이러한 헌법적 요청이 공영방송의 감독기구의 역할 및 구성에 있어서 어떻게 구체화되었는지를 살펴보고자 한다. 이를 통해 독일 공영방송의 지배구조 이면의 헌법적 고려를 확인하고자 한다(Ⅲ). 마지막으로 감독기구에 관한 독일의 주요 개혁 논의 및 최근 연방주방송위원회의 ‘공영방송 개혁을 위한 주간협약’ 입법안을 근거로(Ⅳ) 공영방송의 내부적 조직의 헌법적 요청의 실현에 관한 시사점을 도출하고자 한다.
Abstract
Public broadcasting in Germany is facing fundamental reform. In March 2023, the Broadcasting Commission of the German States established the "Future Council," which presented a report on the future development of public broadcasting in January 2024. On September 26, 2024, the Broadcasting Commission also published a draft "State Treaty on the Reform of Public Broadcasting," which is currently undergoing a public consultation process. Among other things, the draft provides for the establishment of an external Media Council to act as the guardian of public broadcasting's fulfillment of its mandate. This article outlines the key constitutional requirements for public broadcasting, as enshrined in the Federal Constitutional Court's decision on freedom of broadcasting (Section II), and examines how these requirements influence the tasks and composition of the supervisory bodies. The constitutional foundations of the governance of public broadcasting (III) as well as the consequences of the current reform debate and the Broadcasting Commission's recent legislative proposal (III) for a new supervisory body are elaborated (III).
