한국전쟁과 국가보안법 -김수영의 시 「“김일성만세(金日成萬歲)”」를 중심으로-

이 연구는 2015년 김수영의 「“김일성만세(金日成萬歲)”」가 경희대, 고려대에서 대자보로 게재되면서 경찰이 「국가보안법」 위반 여부를 살폈던 해프닝이 일어난 것에 주목했다. 박정희 정권기인 제3·4공화국(1963년 12월 17일~1979년 10월 26일)의 핵심 법제도였던 「반공법」은 전두환 정권기인 제4․5공화국(1980년 8월 27일~1988년 2월 24일)에 「국가보안법」으로 통합되면서 폐지되었으나 한국 사회는 여전히 반공이데올로기의 자장 아래 「국가보안법」이 작동되고 있고, ‘김일성 만세’라는 자유의 문제에서 한 발짝도 나가지 못하고 있다. ‘김일성 만세’라는 자유의 문제에 대한 배경과 맥락을 분석하는 것을 목적으로 다음 사안을 살펴보겠다. 1) 한국전쟁이 발발하면서 반공은 대한민국의 국시(國是)가 되었다. 1948년 12월 1일 법률 제10호 「국가보안법」을 제정·공포했다. 4·19 혁명으로 이승만 정권이 붕괴되고 「우리의 맹서」도 폐지되었지만, 반공 정책은 허정과도정부(1960년 4월 27일~6월 15일)에 의해 체계화되고 장면 내각의 제2공화국(1960년 6월 15일~1961년 5월 16일)에 이르러 공고히 다지게 되었다. 박정희 군사정부(1961년 5월 16일~1963년 12월 17일)는 반공을 국시로 삼고 반공태세를 재정비 강화한다는 공약 이행을 위해 1961년 7월 3일 법률 제643호로 「반공법」을 제정·공포하였다. 2) 반공 정책이 체계화되고 공고히 다지게 된 데 대해 비판으로 김수영은 「“김일성만세(金日成萬歲)”」를 집필하였다. 「“김일성만세(金日成萬歲)”」는 언론의 자유에 대한 고발장이면서 정치의 자유에 대한 고발장이며 출판의 자유에 대한 고발장이기도 하며 결론적으로는 표현의 자유에 대한 고발장이다. 그러나 김수영이 살아 있을 때 발표되지 못했고 2008년 『창작과 비평』 여름호에 미발표 유고시로 발표된 후 2018년 『김수영 전집』 개정판에 수록되었다. 3) 2010년대 이후부터 현재에 이르기까지 박정희 정권 시절 「반공법」 위반으로 유죄를 받았던 사람들의 재심 청구가 이어지고 있다. 김수영이 「“김일성만세(金日成萬歲)”」를 쓴 지 65여 년이 지난 현재 한국 사회에서 ‘한국전쟁’, ‘김일성’, ‘반공’이 갖고 있는 의미를 되짚어보겠다.
Abstract
This study focused on a 2015 incident where the publishing of Kim Soo-young’s “Long live Kim Il-sung” as a protest poster at Kyung Hee University and Korea University led the police to investigate the potential violations of the “National Security Act.” The “Anti-Communist Law,” a core legal framework of during the Park Chung-hee regime’s Third and Fourth Republics (December 17, 1963 – October 26, 1979), was abolished and integrated into the “National Security Act” during Chun Doo-hwan’s Fourth and Fifth Republics (August 27, 1980 – February 24, 1988). However, the South Korean society continues to operate under the influence of anti-communist ideology with the “National Security Law still in effect,” unable to take make a progress in the freedom issue regarding “Long Live Kim Il-sung.” This study aims to analyze the background and context of the freedom issue regarding “Long Live Kim Il-sung” by examining the 1) With the outbreak of the Korean War, anti-communism became South Korea’s national policy. he enacted and promulgated the “National Security Law” (Law No. 10) 1948 on December 1 of the same year. Although the Rhee regime collapsed with the April 19 Revolution and the “Our Oath” pledge was also abolished, the anti-communist policy was systematized by the Heo Jeong transitional government (April 27, 1960 – June 15, 1960) and solidified during the Second Republic under Prime Minister Chang Myon (June 15, 1960 – May 16, 1961). The Park Chung-hee military government (May 16, 1961 – December 17, 1963) adopted anti-communism as a national policy and, in fulfillment of its pledge to reorganize and strengthen the anti-communist stance, established and promulgated the Anti-Communist Law (Law No. 643) on July 3, 1961. 2) As criticism over systematizing and solidifying anti-communist policies, Kim Su-young wrote “Long Live Kim Il-sung,” an indictment of the suppression of freedom of the press, political freedom, and freedom of publication, and ultimately the freedom of expression. However, it was not published during her lifetime; it was posthumously published as an unreleased poem in the summer 2008 issue of “Creation and Criticism,” and was later included in the 2018 revised edition of “Complete Works of Kim Su-young.” 3) Since the 2010s, there have been ongoing appeals for retrials by those convicted of violating the “Anti-Communist Law” during the Park Chung-hee regime. With more than 65 years after Kim Su-young wrote “Long Live Kim Il-sung,” have passed, this chapter will review the meaning of the Korean War, Kim Il-sung, and anti-communism in the contemporary South Korean society.
