소방공무원 현장안전점검관의 역량 제고 방안에 관한 연구

최근 세월호 참사, 이태원 참사, 오송 지하차도 사태에서 볼 수 있듯이 국민은 각종 재난과 사고의 위험에 상시 노출되어 살아가고 있다. 소방공무원은 화재의 예방·경계·진압·구조·구급, 생활민원 등 위급한 상황에서도 자기를 희생하면서 국가·국민의 소중한 생명을 지키고 있다. 최근 10년간 재난 현장에서 위험한 직무에 순직한 소방대원이 총 40명에 이르는 것은 비극적인 일이다. 소방활동 안전관리에 관한 법률적 내용과 제도는 매우 미흡한 실정이다. 이러한 미흡한 안전관리를 위해서는 현장안전점검관 법제를 선진적 국가들과 우리나라의 문헌들을 비교 고찰하여 개선하고자 한다. 특히 중대재해 처벌 등에 관한 법률과 적용한다. 현장안전점검관 제도의 자격제 필요성을 인식하고, 도입하기 위해서는 안전관리 법령을 정비하여야 한다. 이를 위해서는 법규범의 명확성 여부를 판단하고 법령 상호 간의 통합 관리하며 안전관리 체계를 개선할 필요성이 제기된다. 안전관리 전담 조직을 설치하기 위해서는 법적 근거를 마련하고 전문자격인증제도를 신설하여야 한다. 특히 보건안전 직렬을 신설하여 전문적으로 담당할 인력을 양성한다. 국가기술자격 종목 신설 등의 기준에 합당하게 검토하여야 할 것이다. 현장안전점검관의 작업중지권을 도입하여 작업 중 현장에서 위험이 감지되거나 식별되었을 때, 현장안전점검관이 모든 작업을 중단할 수 있는 권한을 부여하여야 한다. 위와 같은 본 고의 주장에 따라 현장안전점검관을 도입하여 신속하고 효율적인 국가안전시스템이 작동되었을 때, 위험사회를 살아가는 국민의 안전은 더욱 확보될 수 있을 것이다.
Abstract
As can be seen in the recent Ferry Sewol disaster, Itaewon disaster, and Osong Underpass, the people are always exposed to the dangers of various disasters and accidents. Fire officials are protecting the precious lives of the country and the people while sacrificing themselves in emergency situations such as fire prevention, alertness, suppression, rescue, first aid, and living civil petitions. It is tragic that a total of 40 firefighters have died in dangerous jobs at the disaster site in the past 10 years. The legal content and system for fire safety management are very insufficient. For such inadequate safety management, the on-site safety inspector legislation will be improved by comparing and reviewing the literature of advanced countries and Korea. In particular, it applies to the law on the punishment of serious accidents, etc. Safety management laws must be reorganized in order to recognize and introduce the necessity of the qualification system for the on-site safety inspector system. To this end, the need to determine the clarity of legal norms, integrate and manage laws and regulations, and improve the safety management system is raised. In order to establish an organization dedicated to safety management, a legal basis must be established and a professional qualification certification system must be established. In particular, a series of health and safety shall be established to cultivate human resources to be in charge of professionally. It should be reviewed appropriately in accordance with the standards for the establishment of national technical qualifications. The right to stop work of the site safety inspector shall be introduced to give the site safety inspector the authority to stop all work when a danger is detected or identified at the site during work. When a rapid and efficient national safety system is operated by introducing an on-site safety inspector in accordance with the above claims, the safety of the people living in a dangerous society can be further secured.
