노인과 인권 -노인인권법의 제정방향을 중심으로-

As the elderly population increases rapidly every year, social conflicts such as family conflicts and generational conflicts are increasing as our society enters a super-aged society. In particular, physical, mental, emotional, economic, and sexual abuse of the elderly is increasing every year, which is a social problem. Accordingly, the United Nations as well as Korea are making efforts by enacting and implementing many related laws such as the Welfare of the Aged Act. Nevertheless, problems of the elderly, such as abuse of the elderly, have not stopped increasing every year. Therefore, this paper attempts to approach the perspective of the elderly problem and the human rights perspective that the elderly are also rights holders. Human rights are a natural right that everyone has, a universal right that everyone enjoys, and a minimum essential and basic right to become a human being with dignity and value, so it is a superior right to the actual law. Thinking about the elderly problem from the perspective of human rights starts from the perspective that the elderly should be argued because they are rights holders. Therefore, the cause of the elderly problem can be found in our society's system rather than individual elderly people. Papers related to the human rights of the elderly mainly focus on elder abuse, discrimination, and facility senior research, and research on improving systems and policies from a human rights perspective is still insufficient.
