The increase in overseas direct purchases through overseas online platforms has the advantage of being able to purchase a variety of products at low prices, but it can also bring about the disadvantage of users’ personal information being collected and transferred by overseas businesses, etc., which can cause unexpected damage to the information subject. In particular, the increase in transactions using Chinese overseas direct purchase online platforms is accelerating these concerns. Chinese overseas direct purchase online platforms have established personal information processing policies to protect personal information of Korean users. Their personal information processing policies can be evaluated positively as they seem to reflect some of the relevant provisions of the Korean Personal Information Protection Act. Representative examples include ‘designation of a personal information protection officer’ and ‘designation of a domestic agent.’ However, in relation to the Korean Personal Information Protection Act, the personal information processing policies of Chinese overseas direct purchase online platforms need to specify careful provisions for protecting consumer rights, and improvements are also needed in the method of obtaining consent for personal information processing. Furthermore, in order to protect the rights and interests of Korean users in relation to the use of Chinese overseas direct purchase online platforms, it is necessary to clearly state the extraterritorial application provisions of the Personal Information Protection Act, and to establish a system for continuous management and supervision of overseas business operators’ handling of domestic consumers’ personal information.
