초록
사이버시대가 가속화됨에 따라 사이버범죄의 양상도 빠르게 진화하고 있는 가운데, 최근 인공지능(AI)을 기반으로 한 사이버범죄가 급격히 증가하면서 심각한 사회적 문제로대두되고 있다. 인공지능은 본래 인간의 삶을 개선하고 효율성을 높이기 위해 개발되었지만, 그 강력한 능력이 범죄자들에게 악용되는 상황이다. 인공지능의 발전은 사이버범죄자에게 자동화된 공격도구를 제공한다. AI는 대량의 데이터를 빠르게 분석하고 패턴을 식별할 수 있는 능력을 갖추고 있어, 이를 통해 더욱 정교하고 효과적인 해킹기법을 개발하는데 이용되고 있다. 또한, AI는 사이버범죄자들이 보안시스템의 취약점을 발견하고 이를 악용하는데 걸리는 시간을 대폭 단축시키고 있다. AI알고리즘은 보안시스템의 약점을 신속하게 분석하고 이를 기초로 새로운 공격방법을개발할 수 있는데, 이 기술은 전통적 보안시스템의 대응능력을 초월하므로 피해를 최소화하기 위한 방어시스템 개선이 시급한 상황이다. 아울러 AI기반 사이버범죄는 특정 타겟을 정밀하게 겨냥할 수 있게 해 준다. 예컨대, AI는 소셜미디어에 공개된 데이터를 분석하여 개인의 습관, 관심사, 심리상태 등을 파악할 수 있고 이를 통해 사이버범죄자들은보다 정교한 심리적 공격을 감행함으로써, 피해자의 방어를 어렵게 한다. 이와 같은 문제를 해결하기 위해서는 더욱 다각적인 접근이 필요하다. AI기술의 발전과 그 악용가능성에 대한 연구와 대응방안이 지속적으로 마련되어야 하는바, 사이버보안전문가들은 AI를 활용한 공격을 탐지하고 방어하기 위한 혁신기술을 개발해야 하고, 일반사용자들에게 사이버보안교육을 실시하여 자기방어능력을 높여야 한다. 나아가 AI기반사이버범죄의 증가는 단순히 기술적 문제를 넘어 사회적, 윤리적 논의 또한 요구한다. 기술의 발전이 가져오는 이점과 위험을 균형 있게 이해하고, 이를 통한 더욱 안전한 디지털환경을 조성하기 위한 노력이 필요한 것이다. 인공지능기반 사이버범죄의 양상을 파악하고 그에 대한 법적 대응전략을 수립할 필요가 시급한 상황이다.
Abstract
As the cyber era accelerates, the nature of cybercrime is also rapidly evolving, and recently, cybercrime based on AI has been rapidly increasing, emerging as a serious social problem. AI was originally developed to improve human life and increase efficiency, but its powerful capabilities are being abused by criminals. The development of AI provides automated attack tools to cybercriminals. AI has the ability to quickly analyze large amounts of data and identify patterns, and is being used to develop more sophisticated and effective hacking techniques. In addition, AI is drastically reducing the time it takes for cybercriminals to discover vulnerabilities in security systems and exploit them. AI algorithms can quickly analyze vulnerabilities in security systems and develop new attack methods based on this, but this technology surpasses the response capabilities of traditional security systems, so it is urgent to improve the defense system to minimize damage. In addition, AI-based cybercrime allows for precise targeting of specific targets. For example, AI can analyze data disclosed on social media to identify an individual's habits, interests, and psychological state, and through this, cybercriminals can carry out more sophisticated psychological attacks, making it difficult for victims to defend themselves. A more multifaceted approach is needed to solve this problem. Research on the development of AI technology and its potential exploitation and countermeasures must be continuously prepared. Cybersecurity experts must develop innovative technologies to detect and defend against attacks using AI, and provide cybersecurity education to general users to enhance their self-defense capabilities. Furthermore, the increase in AI-based cybercrimes requires social and ethical discussions beyond simple technical issues. It is necessary to understand the benefits and risks of technological advancement in a balanced way and to make efforts to create a safer digital environment through this. It is urgent to understand the nature of AI-based cybercrimes and establish legal response strategies for them.
