Sanhuri 민법전을 통하여 본 현대 아랍 민법의 이해

초록
아랍지역이 한국 경제에 미치는 영향이 중대하고, 아국(我國)기업의 오랜 활동 지역임에도 아랍지역 고유의 법학에 관한 체계적인 연구는 아직 부족한 것으로 보인다. 아랍의 법학은 샤리아에 국한된다는 인식이 있으나, 그러한 인식과는 달리 아랍지역은 대부분 우리와 같이 대륙법계에 속하며 다만 이슬람 샤리아 원칙이 프랑스로부터계수된 민법에 융화되었을 뿐이다. 본 연구에서는 흔히 Sanhuri 민법전이라고 불리며 많은 아랍 민법에 모태가 된이집트 민법의 탄생 배경과 그 아버지이자 아랍 법학의 선구자인 Abd El-Razzak El-Sanhuri의 삶에 대하여 살펴보고, 그가 이집트 민법과 다른 아랍지역의 민법을제정하면서 가졌던 철학 및 입법론에 대하여 검토한 후, 국제상거래에 있어서 현대아랍 민법 특수한 쟁점으로 분리되는 Riba 금지와 재판상 해제원칙에 대하여 집중적으로 검토해 보았다. 상기 연구를 위한 비교법적 접근을 위하여 이집트, UAE, 카타르와 함께 최근 제정된사우디아라비아의 민법전을 분석하였다.
Abstract
Despite the long history of our nation’s companies economic activity in the Arab region and the region’s impact on our economy, it seems that our studies about the region’s legal system is lacking. However, despite our belief that the region will be run only on Sharia Law, the Arab region are known to have elected the civil law system while the principle’s of Sharia has been reflected in its code, which is based on the French Civil Code. In this study I have attempted to look at the social background of how the first Sanhuri Code (Egpyt Civil Code) was born and the life of Abd El-Razzak El-Sanhuri, the father of the Egyptian Civil Code and the leading jurist in contemporary Arab civil law. By this, I have attempted to analyze the jurisprudence Sanhuri had when he gave birth to the many Arab Civil Codes and also look at the issue of Riba and Court Mandated Termination principle, which is one of the main issues in contemporary Arab Civil Codes. For this study and the comparative law approach, I have analyzed the relevant provisions in the Egypt, UAE, Qatar and the newly passed Saudi Arabia Civil Code.
