LDA 토픽모델링을 활용한 아동⋅청소년 대상 디지털 성범죄 판례분석

본 연구는 비정형 데이터인 텍스트 대상 빅데이터 분석기법인 LDA 토픽모델링을 활용하여 아 동⋅청소년 대상 디지털 성범죄 판례의 범죄사실에 나타나는 주요 토픽을 실증적으로 분석하였 다. 이를 위해 판례 검색 사이트 ‘빅케이스’에서 ‘아동⋅청소년 성착취물’, ‘아동⋅청소년 음란물’ 을 키워드로 2020년 1월부터 2024년 8월까지 아동⋅청소년의 성보호에 관한 법률을 위반한 판 례를 검색하였다. 그 결과 판례 2,194건을 수집하였고, 범죄의 양태를 파악하기 위해 분석 대상 을 판례의 ‘범죄사실’ 부분으로 한정하였다. 수집한 텍스트 데이터는 토큰화 및 명사 추출, 불용 어 제거, 공통단어 변환, 복합명사 변환 등 전처리 과정을 거쳐 주요 키워드의 워드클라우드 시 각화와 LDA(Latent Dirichlet Allocation) 토픽모델링을 실시하여 분석하였다. 분석 결과 네 개 의 토픽이 도출되었고, 이를 각각 ‘온라인 메신저를 매개로 발생하는 디지털 성착취’, ‘불법 성착 취물의 개인적 소지 및 소비’, ‘조직적 디지털 성범죄’, ‘금전 및 불법 행위와 연관된 디지털 성범 죄’로 명명하였다. 본 연구는 정보통신기술 발달에 따른 디지털 성범죄의 발생 경로와 수단 등 구체적인 양상을 실증적으로 밝히며, 아동⋅청소년 대상 디지털 성범죄의 실태와 특성을 이해하 고 이를 예방하기 위한 정책적 시사점을 제시하고자 하였다. 특히, 새로운 유형의 디지털 성범죄 는 국경을 넘나들며 발생하고 있으며 판단기준이 모호하여 법적 기준에 저촉되지 않는 일부 측 면이 누락될 수 있다. 향후 연구를 통해 법적제재를 피하는 디지털 성범죄의 특성을 반영한 데이 터를 확보하고, 실태를 심층 분석하여 현실적인 예방 대책 마련에 기여할 수 있기를 기대한다.
Abstract
This study analyzes court judgments related to digital sexual crimes against children and adolescents using big data analysis techniques for unstructured text data. Cases were searched using the keywords ‘child and adolescent sexual exploitation material’ and ‘child and adolescent pornography’ from January 2020 to August 2024, collecting 2,194 cases. Data was extracted only from the ‘facts of crime’ section of the cases to identify crime patterns. The collected text data was analyzed through word cloud visualization and LDA topic modeling. The analysis resulted in four main topics: “Digital sexual exploitation through online messengers”, “Personal possession and consumption of illegal sexual exploitation”, “Collective digital sexual crimes”, and “Digital sexual crimes related to finance and illegality” We empirically revealed the specific aspects of the occurrence pathways and means and provided policy implications for prevention. New forms of digital sex crimes are transcending national borders, and certain ambiguous aspects may escape legal judgment and enforcement. Future research should aim to secure data that reflects the characteristics of digital sex crimes designed to evade legal sanctions and contribute to the development of realistic preventive measures through in-depth analysis of their underlying patterns.
