헌법재판소의 낙태죄 헌법불합치 결정 이후 인공임신중절제도의 변화 - 표류(Drift)를 중심으로 한 점진적 제도변화 분석 -
South Korea’s Institutional Changes in Abortion Policy after the Constitutional Court’s Decision: Analysis through Drift

본 연구는 2019년 4월 11일 헌법재판소의 낙태죄 헌법불합치 결정 이후 인공임신중절제도 의 변화를 역사적 제도주의와 제도변화이론의 관점에서 분석하였다. 특히 최근의 역사적 제 도주의자들이 제시한 점진적 제도변화 유형 중 표류(Drift) 개념에 주목하여, 대체입법이 이루 어지지 않은 채 기존 제도의 효력이 상실되고 있는 현 상황을 분석하였다. 연구 결과, 헌법재 판소의 헌법불합치 결정이 인공임신중절제도 변화에 있어 ‘결정적 전환점’ 또는 ‘급진적 제도 변화’로 작용했음에도 불구하고, ‘단절적 제도변화’나 ‘불연속적 제도변화’로 이어지지 않고, 표류(Drift)의 형태로 점진적이고 연속적인 제도변화가 이루어지고 있음을 확인하였다. 또한, 제도의 핵심적 외관이 소멸한 상태에서도 표류(Drift)가 발생할 수 있다는 점, 그리고 표류 (Drift) 이후 추가적인 ‘결정행위(decisions)’가 필요할 수 있다는 점, 표류(Drift)의 하류 효과로 서 양심적 낙태거부권 등이 문제되고 있다는 점 등을 확인하였다. 이러한 분석을 통해 본 연구 는 인공임신중절제도의 변화 분석과 더불어, 기존 제도변화이론을 확장하고 새로운 이론적 시각을 제시하고 있다.
Abstract
It has been over five years since the Constitutional Court of Korea ruled in April 2019 that criminalizing abortion under the Penal Code is unconstitutional. However, no alternative legislation has been enacted to date. This study analyzes the current situation through the framework of institutional change theory, grounded in historical institutionalism. The case analysis reveals that recent changes in the institutional framework for abortion largely exhibit characteristics of gradual institutional change through drift. However, several aspects also diverge from traditional institutional theories. This paper not only examines recent trends in institutional changes regarding abortion but also offers a new theoretical perspective on existing institutional change theories.
