아노미와 중화의 관계: 불법사행행위를 중심으로

초록
사행행위는 합법 여부를 막론하고 부의 축적이라는 목표를 추구한다. 이에 불법사행행위는 재산범죄의 일종으로 간주된다. 한편 Merton은 특히 부의 축적이라는 문화적 목표가 빈곤 등의 사회적조건과 결합할 경우 재산범죄가 등장할 것이라 예상하였다. 즉, Merton은 경제적 목표의 범죄 유발성을 강조한 것이다. 이에 이 연구에서는 문화적 목표와 불법사행행위 간 확률적 인과를 가정하였다. 다만 문화적 목표는 사회적 개념인 반면 불법사행행위는 개인적 현상이다. 즉, 양자 사이에는수준의 차이가 존재한다. 따라서 문화적 목표와 불법사행행위를 직접 연결하기 곤란하다. 이러한논리적 한계를 개선하고자 이 연구에서는 중화이론을 활용하였다. Sykes와 Matza가 개발한 중화의 기술은 개인이 범죄를 사전에 정당화, 합리화함으로서 실행한다고 주장한다. 이 연구에서는 중화의 기술 중 책임의 부인에 주목하였다. 책임의 부인은 개인이 범죄행위의 주체로서 자신을 대신하여 외부 환경을 지목하는 기술이다. 즉, 외부 환경이 개인을 범죄로 인도하였다고 주장하는 것이다. Merton이 주창한 문화적 목표는 개인성을 압도하는바 이 연구에서는 문화적 목표가 책임의 부인을 유도함으로써 불법사행행위가 등장한다고 가정하였다. 이러한 연구의 가설을 검증하고자 한국형사법무정책연구원에서 2014년 수집한 ‘합법불법 사행산업 이용실태조사’ 자료를 활용하여 다중회귀분석을 실시하였다. 분석 결과 문화적 목표는 책임의 부인에 적(+)적 영향을 미친 반면 불법사행행위에는 부(-)적 영향을 미치는 것으로 나타났으며, 책임의 부인의 매개효과는 유의미하지 않았다. 이를 바탕으로 이론 통합의 가능성과 한계를 논의하였다.
Abstract
Whether or not the gambling acts are legal, they pursue the goal of accumulating wealth. Therefore, illegal gambling is considered a kind of property crime. Meanwhile, Merton expected property crimes to appear, especially when the cultural goal of accumulating wealth is combined with social conditions such as poverty. In other words, Merton emphasized the crime-inducing nature of economic goals. Therefore, this study assumed a probabilistic causal relationship between cultural goals and illegal gambling acts. However, while the cultural goal is a social concept, illegal gambling is a personal phenomenon. In other words, there is a difference in level between the two. Therefore, it is difficult to directly connect cultural goals and illegal gambling acts. To improve these logical limitations, the neutralization theory was used in this study. It is argued that the technology of neutralization developed by Sykes and Matza executes crimes by individuals as justification and rationalization in advance. This study focused on the denial of responsibility among the techniques of neutralization. Denial of responsibility is a technology in which an individual points to the external environment on behalf of himself as the subject of a criminal act. In other words, it is argued that the external environment has guided an individual to a crime. The cultural goal advocated by Merton overwhelms individuality, and this study assumed that illegal gambling appeared by inducing the denial of responsibility. In order to verify the hypothesis of this study, multiple regression analysis was conducted using the data of the 'Lawless Illegal Speculative Industry Use Survey' collected in 2014 by the Korea Criminal Law Policy Institute. As a result of the analysis, it was found that cultural goals had a positive (+) effect on the denial of responsibility, whereas the mediating effect of the denial of responsibility was not significant. Based on this, the possibilities and limitations of theoretical integration were discussed
