국제입양법에 따른 국내로의 입양의 요건과 절차

Requirements and Procedures for International Adoptions to Korea under the International Adoption Act

초록

국내로의 입양은 헤이그 국제사법회의가 채택한 「국제입양에서 아동의 보호 및 협력에 관한 협약」(이하 “협약”)의 이행법률로서 제정된 「국제입양에 관한 법률」(2025. 7. 19. 시행 예정, 이하 “국제입양법”)에 의하여 비로소 우리 국제입양법제가 특별히 규율하기 시작하는 것이다. 국제입양법은 국내로의 입양의 요건과 절차를 규정함으로써 국내로의 입양에 있어서 아동의 최선의 이익을 보장하고 해당 절차에 대한 국가의 책임을 강화하고 있다. 다만, 협약 가입 및 국제입양법 제정의 취지를 고려한다면 마땅히 (협약과) 국제입양법이 적용되어야 할 국제입양에 대하여 그 적용이 배제되는 일이 없도록 유의하여야 한다. 보건복지부, 아동권리보장원 기타 업무수탁단체와 가정법원은 아동이 한국 입국 당시 입양 목적이 있었음을 제반사정에 비추어 넉넉히 추단할 수 있음에도 이를 부인하는 일이 없어야 하고, 아동이 한국사회와 충분히 통합되지 않았음에도 아동의 상거소가 한국에 형성되었다고 쉽게 인정하는 일이 없어야 한다. (협약과) 국제입양법에 따른 국내로의 입양은 까다로운 국제사법 쟁점들을 적지 않게 노정한다. 국제입양법 제19조와 국내입양법 제18조는 입양의 준거법이 외국법으로 지정되는 경우에도 적용되는 국제사법 제20조에 따른 국제적 강행법규이고, 국제입양법 제22조 제1항은 외국에서 형성된 법상태 승인의 법리에 기초하여 협약 체약국인 출신국에서의 입양은 계약형 입양이든 재판상 입양이든 한국에서 자동으로 승인된다고 규정하고 있으며, 국제입양법 제22조 제2항은 협약 비체약국인 출신국에서의 입양재판은 민사소송법 제217조 제1항을 유추적용하여 외국재판 승인의 법리를 통하여 국내에서 효력이 인정된다고 규정하고 있고, 국제입양법 제22조 제3항은 협약 비체약국인 출신국에서 입양재판 외 방법으로 성립한 입양은 재차 우리 가정법원의 허가를 받도록 함으로써 일정한 범위에서 간접적으로 준거법 통제를 관철하고 있다. 국제입양법 제22조 제3항과 제23조에 따라 우리 가정법원이 입양허가재판을 하는 경우 국제재판관할과 준거법이 문제되는데, 특히 입양의 준거법인 양친의 본국법이 외국법인 경우 대용과 조정의 법리가 문제될 수 있고, 반정(숨은 반정)의 법리에 의하여 준거법이 한국법으로 지정될 수도 있다. 이제 국제입양법 제6조가 규정하고 있는 국제사법, 국제입양법, 국내입양법 상호간 우열관계를 염두에 두고 국제입양법의 개별 조항에 대한 합목적적인 해석론을 정립해나가야 하고, 해석론으로 극복할 수 없는 문언상 한계가 있다면 법률을 개정하여 논란을 해결하여야 한다.

Abstract

The adoptions of children from foreign countries to the Republic of Korea (“Korea”) will be comprehensively regulated under Korea’s International Adoption Act (“KIAA”), which is set to take effect on 19 July 2025. Enacted to implement the Hague Convention on Protection of Children and Co-operation in Respect of Intercountry Adoption of 1993 (“Convention”), the KIAA establishes detailed requirements and procedures for international adoptions to Korea. Its primary objectives are to safeguard the best interests of the child and strengthen the accountability of the Korean government in managing the intercountry adoption process. This article examines the KIAA’s implications, emphasizing the necessity of ensuring its proper application to prevent cases that fall within its scope from being improperly excluded. The Ministry of Health and Welfare, the National Center for the Rights of the Child, other entrusted organizations, and family courts must avoid denying the applicability of the KIAA in cases where it can be reasonably inferred, based on all relevant circumstances, that the child’s entry into Korea was for the purpose of adoption. Furthermore, they must exercise caution in prematurely recognizing that the child has established habitual residence in Korea, especially in cases where the child has not fully integrated into Korean society. International adoptions to Korea under the Convention and the KIAA raises numerous complex issues of private international law. Both Article 19 of the KIAA and Article 18 of the Domestic Adoption Act are classified as internationally mandatory provisions under Article 20 of Korea’s Private International Law Act (“KPILA”), even if foreign law is designated as the law governing adoption. Article 22(1) of the KIAA, based on the principle of recognition of legal status established abroad, provides that an adoption finalized in the State of origin, whether through a contractual process or a judicial proceeding, is automatically recognized in Korea. Article 22(2) stipulates that an adoption judgment rendered in a non-Contracting State of the Convention is recognized in Korea under the principle of recognition of foreign judgments, applying Article 217(1) of Korea’s Civil Procedure Act mutatis mutandis. Article 22(3) of the KIAA further provides that adoptions established through non-judicial means in non-Contracting States must receive additional approval from Korean family courts, indirectly enforcing control over the applicable laws. When Korean family courts issue adoption approval judgments under Articles 22(3) and 23 of the KIAA, issues of international jurisdiction and governing law arise. In cases where the governing law of adoption is the adoptive parents’ foreign law of nationality, questions regarding the principle of substitution or adaptation may arise. Additionally, the doctrine of renvoi (including hidden renvoi) could result in the governing law being re-designated as Korean law. It is crucial to consider the hierarchy and interaction between the KPILA, the KIAA, and the Domestic Adoption Act, as specified in Article 6 of the KIAA. A teleological and purpose-driven interpretation of the specific provisions of the KIAA should be developed to resolve potential conflicts. Where interpretative efforts prove insufficient to address textual ambiguities, legislative amendments may be necessary to provide clarity and resolve controversies.
