꿈의 해석으로서 공판절차와 회복적 사법으로의 발전에 대한 법정신분석학의 접근 - 영화 <더 헌트> 속 아동성추행 무고 사건을 소재로 하여 -
Criminal Justice System as the Interpretation of Dreams and Its Development Towards Restorative Justice - Using the Film <The Hunt> as a Case Study -

초록
영화 <더 헌트>는 억울하게 아동성추행범으로 몰린 한 남자의 이야기를 다룬 영화이다. 이 영화 속에서 우리는 한 남자를 향한 광기의 마녀사냥과 그 앞에 무력했던 이성법의 한계, 영성을 통한 회복, 그리고 그럼에도 남아있는 공동체의 상흔을 보게 된다. 이 글은 이러한 영화의 주제의식을 법정신분석학적으로 확장하고자 한다. 죄 없이 아동성추행범으로 몰린 한 사람을 향한 마녀사냥을 정신분석학적으로 새롭게 이해해봄으로써 현실이 무의식으로 구성된 꿈과 같은 측면이 있음을 논하고(II), 무의식적 역동이 강력하게 작동하는 법적 사안의 경우에는 사법절차가 무의식을 이해하는 치료적이고 회복적인 것이 되어야 함을 주장하였다(III). 그리고 그런 사법이 되기 위하여는 형식적, 이성적인 것에 머무는 정체성을 뛰어넘어서, 감정과 무의식과도 소통하는 ‘법의 전일성의 회복’을 꿈꿔야 하며, 그런 법이 펼치는 절차를 통해 비로소 광기에 사로잡혔던 공동체가 무의식의 의식화를 통한 이성의 회복을 성취하고 진실을 토대로 다시 세워질 수 있음을, 그리고 이 과정을 통해 비로소 무고 피해자의 진정한 피해회복이 가능함을 고찰하였다. 마지막으로 이렇게 미지의 영역인 무의식의 영역으로 들어가 소송참여자들의 무의식을 함께 탐색하고 진실과 정의를 세워나가는 법관을 드워킨의 ‘법관 헤라클레스’의 발전된 모습으로서 새롭게 제시해보았다(IV). 이러한 논의를 통하여 이 글은 무의식적 환상이 강하게 작용할 수 있는 범죄 유형의 경우, 피해자의 피해 회복을 위해서는 단편적인 유무죄 판단을 넘어선 공동체의 회복이 필요하며, 그 회복을 사법절차가 완성시킬 수는 없지만 회복에 기여하는 방향으로 발전해나갈 필요성이 있음을 주장하고, 그 발전에 법정신분석학이 기여할 부분을 검토해보았다.
Abstract
The film 'The Hunt' tells the story of a man falsely accused of child molestation. In this film, we witness a witch hunt driven by mass hysteria against one man, the limitations of rational law that proved powerless in the face of this hysteria, recovery through spirituality, and the scars that nevertheless remain. This paper aims to expand on these themes through the approach of law and psychoanalysis. Through psychoanalytic examination of the witch hunt against a person falsely accused of child molestation, it discusses how reality can be constructed like a dream from the unconscious (II), and argues that in legal cases where unconscious dynamics operate strongly, judicial procedures should be therapeutic and restorative in understanding the unconscious (III). To achieve such judiciary, it must transcend its identity that remains formal and rational, and dream of 'restoration of its wholeness' that communicates with emotions and the unconscious. Through procedures that restore wholeness, a community once gripped by irrational madness can achieve the restoration of reason through the conscious awareness of the unconscious, rebuild itself on the foundation of truth, and only through such process can true recovery for victims be achieved. Finally, this paper presents a new vision of the judge who enters the unknown realm of the unconscious, explores the unconscious of litigation participants together, as an evolved version of Dworkin's 'Judge Hercules' (IV). Through these discussions, this paper argues that in crimes where unconscious fantasies strongly operate, community recovery beyond simple guilty/not guilty verdicts is necessary for victim’s recovery, and while judicial procedures cannot complete this recovery alone, they need to develop in ways that contribute to it. The paper examines how the interdisciplinary approach of law and psychoanalysis can contribute to this development.
