AI 산업에 관한 법 담론의 사회적 영향

이 연구의 목적은 인공지능 산업과 관련한 법적 담론과 그 사회적 영향에 대해 고찰하는 데 있다. 이를 위해서 그 담론은 사회를 보여주는 창이라 일컫는 언론 속의 자료를 탐색하였다. 또한 AI 산업과 관련한 문헌과 실례를 찾아 해석해 봄으로써 그 기능 방식을 파악하는 전거로 삼았다. 이제 인공지능은 우리의 일상에 깊숙이 침투하였다. 동시에 AI가 인간의 동반자가 되는 현실이 기업들에는 생존의 문제로 맞닥뜨릴 정도가 되었다. 이런 사회적 현상을 반영하듯 「인공지능 발전과 신뢰 기반 조성 등에 관한 기본법」이 국회를 통과했다. 이 법안이 마련되기까지 산업계를 비롯해 사회적으로 수많은 관련 담론이 언론을 통해 생성되었다. AI 기본법을 토대로 한 산업발전은 사회 변화를 반영하면서 법과 사회의 진화를 이끌게 될 것이다. 바로 이러한 사회적 상황은 기업들로 하여금 최첨단의 과학기술을 경제적 성장뿐만 아니라 사회적 가치 창출을 끌어내는 데 쓰도록 유도한다. 지금도 “우리는 AI를 사용할 준비가 되어 있는가”라는 물음이 진행형으로 제기된다. 본 논문은 언론 속 법 담론과 교차한 AI 산업사회라는 틀을 살핌으로써 기존 연구와 차별화를 시도했고 그에 따라 디지털 전환 사회가 바라는 개인이나 기업의 책임성을 강조한다. 또한, AI가 인간을 얼마나 대신할 수 있을까 하는 문제는 AI가 가져올 산업 구조 발전과 새로운 기회 창출에 대한 기대감으로 연결되면서 그에 맞물린 법의 기능을 다시금 떠올릴 수 있을 것이라는 점도 확인해 볼 수 있었다.
Abstract
The purpose of this study is to examine the legal discourse related to the AI industry and its social impact. The discourse examining the relationship was explored through materials appearing in the media, as the media is said to be a window that shows society. In addition, by searching for literature and cases related to the AI industry, the method of functioning was attempted to be understood. AI has now deeply penetrated our daily lives. At the same time, the reality that AI is becoming a companion to humans has become a matter of survival for companies. Reflecting this social phenomenon, the Basic Act on AI passed the National Assembly. Until this bill was prepared, numerous related discourses were created through the media, including in the industrial sector and society. Industrial development based on the AI Act will lead to the evolution of law and society while reflecting social changes. This social situation encourages companies to use cutting-edge science and technology to create social value as well as economic growth. The question of “Are we ready to use AI?” is ongoing. This article attempts to differentiate itself from existing research by examining the framework of the AI industry society that intersects with legal discourse in the media, and accordingly emphasizes the nature of social responsibility given to individuals and companies. And the question of how much AI can replace humans can be linked to expectations about the industrial structural development and new opportunities that AI will bring, and it was also confirmed that the function of the law intertwined with it can be recalled.
