한국사회를 변화시킨 헌법재판소의 주요 결정과 발전방안 모색

초록
헌법재판소는 헌법재판을 실행하는 헌법상의 국가기관으로서 ① 위헌법률심판 ② 탄핵심판 ③ 정당해산심판 ④ 권한쟁의심판 ⑤ 헌법소원심판을 담당하고 있다. 그 중에서 가장 많은 사건 수를 차지하는 것이 위헌법률심판과 헌법소원심판이고, 헌법재판소는 이러한 심판을 통하여 법률에 따라서 만들어진 한국사회제도의 전부 또는 일부에 대하여 헌법합치적 개선․발전을 도모하고, 궁극적으로 헌법질서의 회복과 개인의 기본권을 보장하는 헌법기관의 역할을 수행하여 왔다. 헌법재판소는 지난 35년여 동안 법률 또는 법률조항에 대한 다수의 위헌결정을 통하여 한국사회의 각종 제도를 헌법질서에 합치되도록 점진적 혹은 전면적으로 개선함으로써 한국사회를 변화시켜왔고, 지금도 그러한 역할을 수행하고 있다. 한국사회의 제도를 변화시킨 대표적인 헌법재판소결정으로 ① 호주제도에 대하여 헌법불합치를 선언한 결정(헌재 2005. 2. 3. 2001헌가9등) ② 양심적 병역거부자를 처벌하는 병역법 조항에 대한 위헌(헌법불합치) 결정(헌재 2018. 6. 28. 2011헌바379등) ③ 자기낙태행위를 처벌하는 형법조항에 대한 위헌(헌법불합치) 결정(헌재 2019. 4. 11. 2017헌바127 결정)이 있다. 한편, 헌법재판소의 결정이 보다 더 발전하고 헌법재판소가 신속하고 공정한 재판으로 국민의 신뢰와 지지를 얻기 위해서는 ① 헌법재판소결정의 법리 계승 및 발전 ② 헌법재판소결정의 실효성 확보 ③ 헌법재판소결정의 공정성과 신뢰성 확보가 필요하다.
Abstract
As a constitutional institution that implements constitutional trial, the Constitutional Court of Korea is in charge of the adjudication on constitutionality of statutes, impeachments, dissolution of a political party, competence disputes and constitutional complaints. There are many cases in the Constitutional Court regarding both adjudication on constitutionality of statutes and constitutional complaints. The Constitutional Court has served to promote the development of Korean society under Constitution. The Constitutional Court ultimately guarantees the restoration of Constitutional order and fundamental rights of individuals. There are three leading decisions of Constitutional Court which have changed the Korean traditional system:① the Case on the House Head System(2001Hun-Ga9), ② the Case on the Conscientious Military Objectors(2011Hun-Ba379), ③ the Case on the Crimes of Abortion(2017Hun-Ba127). Three elements are required to get people’s anticipation and trust for the Constitutional Court:① theoretical development on the Constitutional Court Decisions, ② effectiveness secure on the Constitutional Court Decisions, ③ securing the fairness and justice of the Constitutional Court Decisions.
