지속가능성 실현 목적 행정작용에 대한 신속한 행정소송절차 진행을 위한 독일 행정법원법 개정에 대한 연구

Abstract Germany is a country that systematically maintains and operates various legal systems related to climate change. This requires the facilities for import and supply of green energy sources, the expansion of renewable energy generation facilities and the establishment of supply chains, the closure of lignite-based power generation infrastructure and various related follow-up measures, as well as administrative measures such as licensing. However, even if such licences and permits contribute significantly to the realisation of the public interest of ensuring sustainability, this does not mean that administrative litigation is blocked. If such an administrative measure is challenged in court, this could delay the realisation of the public interest that the administrative measure is intended to achieve. In this context, the German legislator modified the german administrative litigation system. This article examines the changes made to the German administrative litigation system by various pieces of legislation in the context of the recent reorganisation of the German administrative litigation system.
