개인정보 처리방침 평가 기준의 정성적 평가 특성에 기반한 분석지표 설계 및 처리방침 작성의 실질적 요건 및 의미 분석

2024년 처음으로 개인정보 처리방침 평가제도가 도입되어 평가가 진행 중에 있으나 개인정보처리자가 공개된처리방침 평가기준의 요구사항을 온전히 이해하기에는 어려움이 있다. 특히 정성적 평가지표의 경우, 전제조건의 특성으로 인하여 실질적 의미와 요구 수준을 명확히 이해하기 어렵다. 따라서 본 연구는 처리방침 작성의 지원도구로써 평가기준의 전제조건을 명확히 이해하고, 처리방침 사례 분석에 적용할 수 있는 정성적 분석지표를 설계하고 지표별 요건과 실제 의미를 분석한다. 즉, ‘쉽게', ‘모호함 없이', ‘정확하게', ‘구체적으로' 등과 같은 전제조건을 공통 특성으로 도출하여 지표화하고, 처리방침 작성지침과 관련 연구를 바탕으로 그 정도를 이해하기 위한 의미를 분석한다. 또한 2024 년 평가대상 기업의 처리방침으로의 적용 시 지표별 대표사례를 분석한다. 연구결과는 평가를 준비하는 담당자나 평가자 모두가 평가지표의 핵심 특성을 깊이 이해하고 대응할 수 있도록 하는 지원도구가 될 것이며, 사회적 비용을 낮추는데도 기여할 수 있다. 또한 이를 토대로 처리방침 작성 시 올바른 방향을 제시함으로써 궁극적으로 정보주체의 권리행사를 강화시키는 효과를 거둘 수 있을 것으로 기대한다.
Abstract
In 2024, privacy policy evaluation system was introduced for the first time and is currently being evaluated. However, it is difficult for processors to understand the published evaluation criteria for privacy policies. In the case of qualitative evaluation indicators, it is difficult to understand their actual meaning and level due to the nature of the prerequisites. Therefore, this study designs qualitative analysis indicators of evaluation criteria and analyzes their practical meaning. Prerequisites are derived from common characteristics and indexed. Based on the writing guidelines, the practical meaning for understanding the level is analyzed. In addition, representative cases are analyzed when applying evaluation indicators to privacy policy. The results will serve as a support tool for managers and evaluators to deeply understand and respond to the core characteristics of evaluation. It is also expected that it will have the effect of strengthening the rights of information subjects.
