현대 기업 환경에서 컴플라이언스 프로그램은 단순한 법적 준수를 넘어 기업의 지속 가능한 성장과 신뢰 구축을 위한 핵심적인 경영 전략으로 자리 잡고 있다. 기업은 점점 더 복잡해지는 글로벌 규제 환경 속에서 법적 리스크를 효과적으로 관리하고, 윤리적 경영을 실현하며, 공정한 경쟁 질서를 유지해야 하는 과제에 직면해 있다. 그러나 현실적으로 컴플라이언스 프로그램은 국가별 상이한 법률 체계와 규제 충돌, 기업 규모에 따른 자원 격차, 형식적인 운영 방식, 경영진의 윤리적 리더십 부족 등의 문제로 인해 실질적인 효과를 거두지 못하는 경우가 많다. 특히, 중소기업은 전담 조직과 자원의 부족으로 인해 규제 준수의 어려움을 겪고 있으며, 일부 기업에서는 법적 요구사항을 형식적으로 이행하는 데 그쳐 컴플라이언스의 본래 목적이 약화되고 있다. 본 연구는 이러한 한계를 분석하고, 보다 효과적인 컴플라이언스 운영을 위한 개선 방안을 제시하는 것을 목적으로 한다. 이를 위해 글로벌 규제 조화와 국제 협력 강화, 중소기업 지원 확대, 기술 혁신을 활용한 운영 효율성 제고, 내부 통제 시스템 강화, 그리고 조직 전반의 윤리 문화 정착 등의 전략적 방안을 도출하였다. 특히, 기술 기반의 모니터링 시스템과 내부고발자 보호제도 강화를 통해 규제 준수의 실효성을 높이고, 경영진의 윤리적 리더십을 강조함으로써 기업 내 윤리경영의 중요성을 부각시키는 방향을 제안한다. 본 연구를 통해 컴플라이언스 프로그램이 단순한 법적 의무 이행을 넘어 기업의 장기적인 경쟁력 강화와 공정한 시장 환경 조성을 위한 실질적인 도구로 기능할 수 있도록 하는 방안을 모색하고자 한다. 이를 통해 기업이 변화하는 글로벌 규제 환경에 능동적으로 대응하고, 신뢰받는 지속 가능한 경영 체계를 구축하는 데 기여할 수 있기를 기대한다.
Abstract
In the modern corporate environment, compliance programs have evolved beyond mere legal adherence to become a critical strategic tool for ensuring sustainable growth and fostering trust. Companies must navigate an increasingly complex global regulatory landscape while effectively managing legal risks, implementing ethical management practices, and maintaining fair competition. However, in reality, compliance programs often fail to achieve their intended effectiveness due to challenges such as discrepancies between national legal frameworks, regulatory conflicts, disparities in resources based on company size, superficial implementation, and a lack of ethical leadership among executives. In particular, small and medium-sized enterprises (SMEs) struggle with compliance due to limited dedicated personnel and resources, while some companies merely fulfill legal requirements as a formality, thereby undermining the true purpose of compliance. This study aims to analyze these limitations and propose more effective strategies for compliance program implementation. Specifically, it explores measures such as enhancing global regulatory harmonization and international cooperation, expanding support for SMEs, leveraging technological innovations to improve operational efficiency, strengthening internal control systems, and fostering an organization-wide culture of ethical business practices. Notably, the study emphasizes the importance of technology-driven monitoring systems and whistleblower protection mechanisms to enhance regulatory compliance effectiveness. Additionally, it highlights the role of ethical leadership among executives in reinforcing corporate integrity and accountability. Through this research, we seek to establish compliance programs as a practical tool not only for fulfilling legal obligations but also for enhancing long-term corporate competitiveness and creating a fair market environment. By proactively adapting to the evolving global regulatory landscape, companies can build sustainable and trustworthy governance frameworks that contribute to their continued growth and public confidence.
