AI 시대의 진입은 법률시장과 법률산업구조, 업무 처리방식 및 업무 내용에 있어서 전방위적 변화를 일으키고 있다. 이에 미래 법률가들은 기존의 법학 교재의 법규와 판례만으로는 해결하기 어려운 새로운 법률적, 현실적 문제들에 대해 스스로 답을 찾아 나가야 하는 어려운 과정을 끊임없이 마주하게 될 것이다. 그러므로 대학에서의 법학 교육은 미래 법률가들의 창의성을 함양하는 데에 더욱 중점을 두고 이루어질 필요가 있다. 이 점에서 비교법 교육은 법률가로서의 창의적 사고능력을 함양하는 가장 좋은 교육방법 중 하나로서의 역할을 수행할 수 있다. 따라서 본 연구에서는 중국 화동정법대학교에서 진행한 “비교법연구와 창의” 강의 진행 사례를 중심으로, 비교법 교육에 창의적 사고 함양 교육을 융합한 강의 구성 방안을 제안한다. 이 수업의 주된 구성요소는 첫째, 법률가로서의 사고 체계 비교: 영미법계와 대륙법계의 기본적 특성과 함께 양 법계 법률가의 주된 사고방법의 차이를 학습한다. 둘째, 전 세계의 최신 입법 경향 교육: 아직 국내에서는 논의가 거의 진행되지 않고 있지만, 해외에서 이미 입법되었거나 입법안으로서 검토되고 있는 내용에 대해 학습한다. 이를 통해 기존에 접해보지 못한 해외의 최신 법률 쟁점 및 입법 경향을 이해하도록 한다. 셋째, 동일 문제에 대한 상반된 해외 입법례 및 판례 교육: 동일 문제에 대한 서로 다른 입법례 및 판례를 비교 분석하는 과정을 통해 확산적 사고능력 또는 비판적 사고능력을 배양한다. 수업진행방식은 강의와 토론, 토의, 문답 등 다양한 교수 방법을 혼합적으로 적용함으로써 학생들의 새로운 법률문제에 대한 적응력과 문제해결능력을 높이고, 법률 논증 전개에 있어서의 창의적 사고 또는 비판적 사고를 촉진한다.
Abstract
The entry of the AI era is causing sweeping changes in the legal market and lawyers, including the structure of the legal industry, the way lawyers work, and the content of their work. As a result, future lawyers will be constantly faced with the difficult process of finding answers to new problems that cannot be answered directly by existing law school materials. Since it will be difficult to solve various new legal and practical problems in the future with only the laws and precedents contained in the existing legal curriculum, legal education at universities should focus more on cultivating the creative thinking ability or 'creative legal mind' offuture lawyers.Creative thinking skills can be cultivated through exposure to new knowledge that is differentiated from existing knowledge and through the process of learning how to think about different perspectives and solutions to the same problem. In this regard, comparative law education can serve as one of the best ways to cultivate creative thinking skills as a lawyer.This article focuses on the case of the "Comparative Legal Research and Creativity" course at East China University of Political Science and Law, and proposes a plan to organize a course that combines creative thinking education and comparative law education, with the primary goal of fostering a creative mindset. The main components of this course are: first, a comparison of legal systems of thought, in which you will learn the basic characteristics of the Anglo-American and Continental legal systems, as well as the differences in the main ways in which lawyers in both systems think. Second, students learn about the latest legislative trends abroad that have not yet been discussed in Korea, but have already been enacted or are being considered as legislation.Third, through the education of conflicting overseas legislative cases and precedents on the same factual issue, students will learn to develop their diffuse thinking skills and critical thinking skills through the process of comparing and analyzing different legislative cases and precedents on the same factual issue.
