교통약자의 이동권 보장에 관한 헌법적 검토 ― 장애인의 이동권 관련 헌법재판소 판례의 분석을 겸하여 ―
A Constitutional Study on the Right to Mobility for Transportation Disadvantaged Persons

초록
장애인이나 노인, 임산부 등과 같이 이동에 불편함을 느끼는 사람들은 교통시설이나 여객시설 등을 이용하는 데 많은 제약을 받고 있다. 그런데 이동이 불편한 사람들이 일상생활에서 자유로운 이동성을 확보하는 것은 이들이 헌법상 보장된 기본권을 실질적으로 향유할 수 있는 전제조건이 된다. 따라서 국민의 기본권을 보장할 의무를 지는 국가로서는, 교통약자들의 이동과 접근을 가로막는 각종의 장벽들을 제거하여 이들의 사회활동 참여와 복지 증진에 적극적인 노력을 기울여야 할 헌법상 책무가 있다. 이러한 문제의식 하에서 교통약자의 이동권 보장에 관한 헌법적 기초와 이를 실현하기 위한 입법적 대응 등에 대해 검토하였다. 구체적으로 먼저 교통약자에게 이동권의 보장이 갖는 헌법적 의의, 교통약자의 이동권을 도출할 수 있는 헌법적 근거, 교통약자의 이동권을 기본권으로 인정할 수 있는지 여부 등에 대해 검토하였다. 다음으로 교통약자의 이동권을 실질적으로 보장하기 위한 해외의 주요 입법례를 개관하고, 국내외 관련 입법의 주요 내용을 살펴보았다. 이어서 헌법재판소에서 장애인의 이동권 침해 여부가 다투어진 사례들을 중점적으로 분석하였다. 교통약자의 이동권이 명목적인 것에 그치지 않고 실질적으로 보장되는 수준에 이르려면 상당한 재정적 부담이 수반될 수밖에 없다. 하지만 모든 개인은 일정한 시기에 교통약자의 지위에 있었거나 장래에 그러한 지위에 놓일 가능성이 높고, 실제로 전체의 인구 중 교통약자의 비중이 점차 높아져 가고 있다. 이러한 점을 고려할 때 교통약자의 이동권 보장이 단지 특수한 일부 집단의 이해관계에 그치는 것이 아니라 모든 국민에게 있어 삶의 질과 직결되는 보편적인 과제라는 점을 자각할 필요가 있다. 이에 따라 모든 국민이 사회연대의 원리, 공존과 관용의 정신에 기초하여 교통약자의 이동권을 증진하는 데 다 함께 힘을 모아나가야 할 것이다.
Abstract
Transportation Disadvantaged Persons face many restrictions in their daily lives, including access to transportation and passenger facilities to get where they need to go. Securing free mobility for Transportation Disadvantaged Persons is a prerequisite for them to actually enjoy their constitutionally guaranteed fundamental rights. Therefore, as a state that is obligated to guarantee the fundamental rights of its citizens, it is necessary that the state and local governments should make active efforts to promote the welfare and participation in social activities of Transportation Disadvantaged Persons by removing various barriers to their mobility and access. In this article, I focused on the Right to Mobility of Transportation Disadvantaged Persons, and examined the constitutional basis of the right, the legislation to effectively guaranteed the right, and the related precedents of the Constitutional Court. Specifically, I examined the constitutional significance and constitutional basis of the Right to Transportation, Next, I reviewed the major legislative examples that have effectively guaranteed the Right to Transportation for Transportation Disadvantaged Persons. Subsequently, I analyzed the cases related to the Right to Transportation of persons with disabilities among decisions of the Constitutional Court of Korea.
