이 글은 클로이 테일러의 『푸코, 페미니즘, 성범죄: 반구금주의적 분석』에 대한 해제로서, 저자에 대한 소개와 더불어 이 연구서에서 그녀가 가지는 문제의식 및 책의 구성과 내용을 간략하게 소개한다. 이 책은 서론과 결론을 제외하고 전체 3부(각 부 3장, 총 9장)로 구성되어 있으며, ‘제1부: “목가적 쾌락”? 페미니스트의 푸코 읽기’는 제1장: 샤를 주이와 소피 아당의 사건, 제2장: 성범죄법 개정, 제3장: 불명예스러운 인물들과 위험한 개인, ‘제2부: 성범죄자의 규율과 처벌’은 제4장: 페미니즘, 범죄, 처벌, 제5장: 푸코의 감옥 폐지론, 제6장: 퀴어의 범죄화, ‘제3부: 도착의 이식’은 제7장: 도착의 이식과 성 노동, 제8장: 동물성애 섹슈얼리티와 이종 간 성폭력, 제9장: 성적 연쇄살인범의 사회적 구성으로 이루어져 있다. 책의 저자는 푸코에 대한 페미니스트의 비판에 소극적․적극적으로 동조하지만, 그럼에도 성범죄와 젠더폭력에 대한 푸코의 논의에 철학적․정치적 통찰의 핵심이 담겨 있다고 본다. 비록 성범죄와 관련해서 푸코가 성인 남성으로서의 오만한 지각을 드러내기는 하지만 그가 했던 감옥에 대한 비판과 섹슈얼리티의 구성에 대한 분석을 결합하는 작업은 성범죄라는 주제 탐구에 생성적이다. 저자는 이런 방법론에 따라 감옥을 분석함으로써, 성범죄 대응으로서의 감옥은 폐지의 대상임을 입증한다. 페미니스트-푸코주의자라는 단호한 자신의 이데올로기적 입장을 견지하고 있음에도 자기 견해를 강요하지 않고 다양한 견해에 대해 존중심을 가지며 그 주장의 논리를 끝까지 따라가 보는 저자의 사고방식과 글쓰기 태도는 성범죄에 대한 현행 형벌과 응보주의적 대응책으로서의 감옥이 무용하다는 저자의 주장을 더욱 설득력 있게 한다. 폐지주의는 규범적 논리성에서 비판을 받지만, 여전히 영향력 있는 목소리로 평가되며, 이런 점에서 저자의 후속 연구에 기대가 크다.
Abstract
This article is a Review of Foucault, Feminism, and Sexual Crime: An Anti-Prisoner Analysis (Routledge, 2019) by Chloë Taylor. It introduces the author(academic biography), briefly discusses her problem consciousness, and outlines the composition and content of this study. While Chloë Taylor both passively and actively engages with feminist critiques of Foucault, she nonetheless argues that Foucault’s discussion of sexual and gendered violence contains a crucial element of philosophical and political insight. Despite Foucault’s arrogant perceptions of adult masculinity in the context of sex crimes, his critique of prisons, when synthesized with his analysis of the construction of sexuality, proves particularly effective for examining the topic of sexual offenses. Through this methodology, Taylor compellingly demonstrates that prisons, as a response to sex crimes, substantiate the case for abolition. Taylor’s approach to thinking and writing —marked by respect for diverse perspectives and a commitment to following arguments to their logical conclusions, while maintaining a firm feminist-Foucauldian stance— enhances the persuasiveness of her critique of the ineffectiveness of punitive and retributive responses to sex crimes. While abolitionism faces critique for its normative framework, it remains a compelling and influential perspective, generating significant anticipation for Taylor’s future work.
