국제중재에서 기술의 활용에 관한 국제동향과 시사점

International Trends and Implications on the Use of Technology in International Arbitration

초록

In international arbitration, new technologies are further developing the advantages of the arbitration system, creating a new paradigm for dispute resolution. Technology is playing a significant role in changing the practice of arbitration and has the potential to become a game changer in the competition among international arbitration institutions. Major international arbitration institutions already have developed and operated ODR platforms under the name of "Case Connect" or "Gateway" that enable online arbitration applications, advance payment of arbitration costs, delivery of letters, documents, and arbitral awards. The Korean court has already established an electronic litigation system in 1999, and has already completed the advancement work by investing about KRW 66.5 billion over for five years from 2020 to 2024. Meanwhile, the Ministry of Justice announced the “Second Basic Plan for Promotion of Arbitration Industry (2024-2028)” in December 2024, and pointed out that the “absence of an online dispute resolution system to meet the demands of the times for electronic arbitration” is one of the factors for the lack of a foundation for the arbitration industry in Korea, and is preparing to build an electronic arbitration system for the Korean Commercial Arbitration Board (KCAB). Under these circumstances, this study examines the technologies and tools for building an ODR system in Chapter II, and examines the current status of ODR platforms and AI utilization by major overseas arbitration institutions in Chapter III, and then this study derives implications for the construction of an efficient and effective electronic arbitration system by our government and the Korean Commercial Arbitration Board and proposes improvement measures.
