사회복지사 일·생활 균형의 법률 및 지자체별 조례 분석 : 법적 실효성을 중심으로
A Legal Analysis of Laws and Local Ordinances on Work-Life Balance for Social Workers : Focusing on Legal Effectiveness

초록
사회복지사는 근무 지역에 따라 일·생활 균형 제도의 시행 수준에서 차이를 경험한다. 이는 일·생활 균형 제도가 다양한 법률적 영역에서 다루어지며, 지방자치단체별 조례에 따라 정책의 범위와 내용이 상이하게 보장되기 때문이다. 본 연구는 사회복지사 일·생활 균형 보장을 위한 법률 및 조례의 법적 실효성을 검토하고, 지자체별 조례 차이를 분석 하는 것을 목적으로 한다. 이를 위해 「근로기준법」, 「남녀고용평등과 일·가정 양립 지원 에 관한 법률」, 「사회복지사 등의 처우 및 지위 향상을 위한 법률」 등 주요 법률을 검토 하고, 전국 17개 광역지방자치단체의 관련 조례를 내용 분석하였다. 연구 결과, 법률은 일·생활 균형의 기본적 틀을 제공하지만, 조례의 구속력과 지원 수준의 지역별 차이가 커 실질적 효과성이 제한되었다. 이에 책무의 수준, 구속력의 수준, 실행 수준을 높여 조례의 법적 실효성 및 강제성을 강화하여 사회복지사 일·생활 균형을 보장할 필요가 있다. 본 연구는 사회복지사의 일·생활 균형을 보장하는 법률과 조례를 객관적이고 실질 적으로 분석하고, 사업 시행 수준과 법적 실효성을 평가하고 논의하였다는 점에서 의의 를 가진다.
Abstract
Social workers face regional disparities in accessing work-life balance provisions, largely shaped by local government ordinances that define responsibilities to varying extents. This study investigates the legal effectiveness of laws and ordinances designed to support social workers’ work-life balance and analyzes regional differences in local ordinances. To achieve this, the study analyzes key national legislation, including the 「Labor Standards Act」, 「Equal Employment and Work-Family Balance Assistance Act」, and the 「Act on the Improvement of Treatment and Status of Social Workers」. Additionally, a content analysis of ordinances from 17 metropolitan municipalities was conducted. The findings indicate that while laws provide a fundamental framework for work-life balance, the binding force and support level of ordinances vary significantly by region, limiting their practical effectiveness. Therefore, it is necessary to enhance the accountability, binding force, and implementation levels of local ordinances to strengthen their legal effectiveness and enforceability in ensuring social workers' work-life balance. This study holds significance for its objective and comprehensive analysis of the legal and regulatory frameworks that underpin work-life balance provisions for social workers.
