CISG 및 베트남상법상 매수인의물품 검사 및 부적합 통지의무에 관한 연구

Purpose : This study primarily concerns the buyer's obligation to examine the goods and notify non-conformity of goods under the United Nations Convention on International Sale of Goods(1980) in comparison with Viet Nam Commercial law. It describes and analyzes the provisions of the CISG and Viet Nam Commercial Law to evaluate them in light of the discipline of comparative law. Likewise, It aims facilitate the systematic development and reform of Viet Nam Commercial Law found by the comparative study. Research design, data, methodology : To accomplish the objectives of this study, it draws upon a review of literature, including academic articles, reference books, legal precedents, theses, and other relevant sources. Results : It outlines and examines the rules regarding the scope of application, the timing requirements for examining goods and notifying non-conformities, the consequences of failing to fulfill these obligations, and the applicable exemptions. Conclusions : Traders intending to enter the Vietnamese market should thoroughly understand the buyer’s obligation to exaime goods and notify non-conformities under the Vietnam Commercial Law to prevent unforeseen disputes, particularly when it is designated as the governing law.
