Reflecting on the Academic Journey of the Ever-Youthful Professor Jonghee Park - A Focus on Individual Labor Law -

This article provides a retrospective analysis of Professor Jonghee Park's academic contributions, particularly focusing on the relevance of each study within the domain of individual labor law. By examining key research works in this area, the article highlights the significance and impact of Professor Park’s scholarship on labor law discourse. Professor Park's research has consistently addressed the most pressing labor law issues at the time of publication. While this study limits its discussion to individual labor law, a similar pattern is evident in his research on collective labor law. Notably, his work on industrial unions during the early 2000s—when the transition to an industrial union system was in progress—provided critical insights. His studies on the concept of federations, internal relationships within federations, redefinition of union control based on contract law, distinctions between union reorganizations, mergers, and splits, as well as his extensive analyses on collective bargain- ing legislation, have all significantly influenced labor law development in South Korea. His contributions include discussions on the confirmation of bargaining parties, delegation of bargaining authority, unification of bargaining channels, exclusive bargaining systems, the duty of fair representation, and the autonomy of agreements. This article reassesses the trajectory of Professor Park’s research as an ongoing exploration of the “right” form of labor law. Over the past 30 years, labor legislation in South Korea has expanded rapidly in quantity; however, its sophistication remains insufficient, and many essential legislative issues remain unresolved. In this context, Professor Park has played a crucial role in filling legislative gaps through rigorous legal interpretation. His scholarship reflects a sustained effort to refine labor law, not merely through statutory expansion but also a nuanced interpretative approach. Through this analysis, the article underscores the enduring relevance of Professor Park's work in shaping labor law discourse and legislative development in South Korea.
