고령운전자의 교통사고 예방을 위한 법적 소고- 이동권리의 보장과 인공지능(AI)기술의 활용을 중심으로 -

초록
우리나라는 이미 초고령화 사회에 진입하고 있다. 앞으로 고령운전자는 더욱 늘어날것이며 이로 인해 발생하는 사고의 예방과 대응책 마련이 절실한 상황이다. 실제로 우리나라의 전반적인 교통사고 발생 건수는 감소하는 추세이나, 75세 이상의 고령운전자에의한 교통사고는 급속히 증가하고 있다. 더욱이 고령운전자로 인해 교통사고에 휘말린피해자의 인명피해 규모는 다른 연령대의 운전자에 비해 심각한 수준을 보이고 있어 사회적 우려를 키우고 있다. 교통사고를 예방하기 위하여 고령운전자의 운전 기회를 제한해야한다는 의견도 있으나 대중교통 이용이 쉽지 않은 지방의 경우 이동을 하기위해서 어쩔 수 없이 운전을 해야하는 상황이다. 따라서 지방자치단체가 고령자의 교통안전을 보장함과 동시에 이동권까지 아울러 보장하는 복지적 접근 해결 방안도 필요하다. 최근 급발전하고 있는 인공지능(AI) 기술을 활용한 교통안전 대책도 중요한 해결 방안으로 떠오르고 있다. 예컨대, AI 기반의 첨단 운전자 보조 시스템(ADAS 등)을 통해 고령운전자가 안전하게 운전할 수 있도록 지원하는 기술이 개발되고 있다. 이러한 기술의 보급과 활성화를 통해 안전한 환경을 조성할 수 있다. 더 나아가 자율주행 차량 기술이 고령 운전자의 차량에 적용된다면 늘어나는 고령운전자를 위한 미래형 대안으로 생각할수 있다. 본 연구는 고령운전자의 안전한 운전 환경을 제안하고 이를 위한 법적 근거를 살펴본다. 그리고 고령운전자의 교통사고 문제를 줄이기 위한 해결 방안을 제시한다. 특히 AI 기술과 인프라 조성 등의 방식을 활용하는 방안으로 고령운전자의 교통사고를 예방하고, 나아가 고령운전자의 이동권 확보에도 기여한다.
Abstract
Our society is aging, leading to increased traffic accidents involving elderly drivers and heightened social anxiety. Addressing this requires ensuring traffic safety while protecting the mobility rights of elderly drivers. These accidents stem from multiple factors, including declining physical and cognitive abilities, poor driving habits, and road conditions. Thus, comprehensive measures are needed, such as improved driver evaluations, tailored education programs, safer road environments, and promotion of public transport to prevent accidents and reduce anxiety. Leveraging AI technology, particularly advanced driver assistance systems (ADAS), can support safer driving for the elderly. Furthermore, autonomous vehicle technology offers future alternatives for safe and convenient mobility without self-driving. Government and local authorities should revise related laws, invest in AI development, and tailor local policies to support elderly drivers'mobility and enhance overall traffic safety. Societal attention and concerted efforts are crucial to safeguarding both elderly drivers and the broader community.
