재일조선인 북송 이후의 문제와 한국의 역할 -북송사업 손해배상 청구 소송을 중심으로-

This study aims to confirm the basis of the illegality of the repatriation project and suggest a direction for future recovery of damages by focusing on lawsuits for damages filed by victims who migrated to North Korea through the repatriation project for Koreans in Japan carried out from 1959 to 1984, lived a life of human rights oppression in North Korea for decades, and then defected and resettled in Japan. The study analyzed the progress of the lawsuit that was ongoing from 2018 to 2023 through newspaper articles, the official website of the NGO “Let’s All Gather” that led the lawsuit, interviews with related parties, court decisions, and other materials. This study goes beyond existing studies that focused on the circumstances surrounding the repatriation project itself and sheds new light on the victims’ lives in North Korea after the repatriation, and approaches the possibility of remedying their rights. The North Korea repatriation project is a product of multilateral exchanges among the governments of Japan and North Korea, and the Red Cross of both countries, South Korea, the Soviet Union, the United States, Chongryon, and the International Committee of the Red Cross, so it is meaningful to call for responsible solidarity among them to recover the damage, and to emphasize a responsible attitude as a mother country by exploring South Korea's role in promoting human rights in North Korea.
