초록
본 논문은 등기되지 않은 건축물, 즉 미등기 건물에 대한 강제집행의 법적 가능성과 실무적 한계를 분석하고, 이에 대한 제도적 개선 방안을 제시하는 것을 목적으로 한다. 현행 민사집행법 제81조는 미등기 건물에 대한 강제집행을 제한적으로 허용하고 있으나, 요구되는 입증 서류의 범위가 지나치게 엄격하고, 집행 실무에서도 일관된 기준이 마련되어 있지 않아 채권자의 권리 실현이 현실적으로 어렵다. 또한 대법원은 일관되게 미등기 건물의 유체동산 집행 가능성을 부정함으로써, 채무자가 고의적으로 등기를 회피할 경우 집행의 실효성이 무력화될 우려가 있다. 이에 본 논문은 일본 등 외국의 입법례를 비교 분석하고, 국내 판례 및 학설 검토를 통해 미등기 건물 강제집행의 법리적 쟁점과 제도적 공백을 진단하였다. 나아가 간이등기 제도의 도입, 집행방식 전환 절차 마련, 민사집행규칙 정비, 행정기관과의 연계 강화 등 현실적이고 균형 잡힌 제도 개선 방안을 제안함으로써, 향후 미등기 건물 집행의 실효성을 제고하고 강제집행 제도의 신뢰성을 높이는 데 기여하고자 한다.
Abstract
This study examines the legal feasibility and practical limitations of enforcing compulsory execution against unregistered buildings in Korea. While Article 81 of the Korean Civil Execution Act conditionally allows enforcement on such properties, the procedural requirements remain excessively rigid and inconsistently applied in practice, hindering creditors’ ability to realize their rights. Furthermore, the Supreme Court maintains a restrictive stance that denies the classification of unregistered buildings as movable properties, enabling debtors to avoid enforcement by deliberately delaying registration. Through a comparative analysis of foreign legislative models, particularly that of Japan, along with a critical review of domestic case law and academic discussions, this study identifies systemic gaps and legal uncertainties surrounding the issue. It then proposes concrete institutional reforms, such as introducing provisional registration systems, enabling transitions between movable and immovable enforcement procedures, amending subordinate regulations, and improving cooperation with administrative agencies. The ultimate aim is to enhance the effectiveness of compulsory execution procedures and restore trust in the legal system governing property rights enforcement.
