친자관계 결정에 대한 중국 민법의 동향 및 향후 과제

초록
중화인민공화국이 수립된 이래, 중국의 혼인가족법은 내용적인 측면에서 괄목할 만한 발전을 이루었다. 그러나 현대적인 관점에서 바라보는 중국의 혼인가족법에는 여전히 체계적인 공백이 존재하며, 가장 대표적인 분야가 바로 친자법이다. 친자법은 부모와 자녀관계에서 비롯되는 일반적인 권리와 의무를명시하는 데 집중되어 있을 뿐 법적 친자관계의 성립에 관해서는 명시적인 규정조차 존재하지 않아 제도의 대강을 파악하는 것도 어려운 실정이다. 이에 이논문에서는 중국의 친자법에 대한 해석을 제공하는 데에 1차적인 연구의 목적을 두었으며, 중국 친자법의 발전과정에 대한 일반적인 고찰에서 시작하여, 2020년 제정 민법의 성과라고 할 수 있는 제1073조에 대한 소개와 해석을 겸하여 현행 중국 민법상 친자관계의 성립과 그 결정기준을 분석하였다. 그리고현행 친자법에 대한 해석을 바탕으로 친자관계의 성립 및 이의제기를 위한 요건의 명확화, 친자관계 분쟁에 있어 입증책임에 관한 법리 정비, 실질적인 혈연 평등의 확보, 친자관계의 결정 원리로서 아동의 최선의 이익 구체화 등에관한 주요 입법과제를 제시하였다. 다만, 이에 앞서 중국의 민법이 해결해야하는 일차적인 과제는 법적 친자관계의 성립과 부인, 그 결정기준 등 친자관계확정에 관계하는 전반적인 제도를 명문으로 규정하는 것이다. 중국의 현행 친자법은 모호하거나 논의가 필요한 지점이 적지 않고 이와 같은 제도의 불명확성으로 인해 자녀의 법적 지위는 여전히 불안정한 상태에 놓여 있다. 따라서친자법이 법적 안정성을 담보하고 현실지배적인 규범력을 확보할 수 있도록관련제도를 수립하고 보완해 나가야 한다.
Abstract
Since the establishment of the People's Republic of China, China's marriage and family law has made remarkable progress in terms of content. However, from a modern perspective, China's marriage and family law still contains systematic gaps, with one of the most prominent areas being legal system of parentage. It focuses on specifying the general rights and duties arising from the parent-child relationship, but there are no explicit provisions regarding the establishment of a legal parent-child relationship, making it difficult to grasp the overall framework of the system. Therefore, the primary research objective of this paper is to provide an interpretation of China's Civil Code concerning the legal system of parentage. Starting with a general consideration of the development of China's legal system of parentage, the paper introduces and interprets Article 1073 of the Civil Code and analyzes the establishment of the parent-child relationship and its criteria. Based on the interpretation of the current law, this paper presents legislative tasks for the future development of the Chinese Civil Code. Relevant systems should be developed and improved to ensure that China's legal system of parentage provides legal stability and achieves normative effectiveness in practice.
