직업병과 인과관계 증명 -독일에서 논의를 중심으로-

초록

본고는 직업병과 인과관계 증명에 관하여 독일법상 법리를 중심으로 논의한 글이다. 직업병 혹은 업무상 질병에서 인과관계는 그 인정을 위한 핵심적 표지이다. 그런데 인과관계를 증명하는 것은 무척이나 힘들 것이 보통이다. 이는 직업병이 상당한 잠복기를 거치거나 장시간 동안 유해인자에 노출되어 발생하는 경우가 보통이고, 업무와 관련된 유해한 영향뿐만 아니라 피재자(被災者)의 기저질환 또는 체질적 소인도 작용하여 발병하는 경우가 흔하기 때문이다. 독일에서 직업병은 사회법전 제7권 제9조에서 규율하고 있고, 독일의 경우 ‘한정적 열거주의’를 기본으로 채택하면서, 준(準)직업병의 규율로 이를 보완하는 체계를 이루고 있다. 특히 직업병의 구성요건의 규율은 최소 노출량의 규정하고 그 증명을 요구하는 엄격한 직업병 구성요건의 경우와 이를 규정하지 않은 개방적 직업병 구성요건으로 대별할 수 있다. 또 제9조 제3항은 인과관계에 관한 원고의 증명책임을 완화하기 위하여 인과관계 추정에 관한 규정을 두고 있다. 독일의 연방사회법원(BSG)은 직업병을 승인하기 위하여 해당 영향과 해당 질환 간의 인과관계뿐만 아니라 해당 영향과 업무 수행 간의 인과관계가 인정될 것을 요구하고 있다. 이러한 인과관계의 판단은 ‘절대적 제약공식(= 조건설)’에 따른 인과관계를 판단하는 1단계와 ‘중요조건설’에 따른 인과관계를 판단하는 2단계를 거쳐 이뤄진다. 우리의 실무가 ‘상당인과관계설’에 입각하여 그 인과관계를 판단하는 것과 대비되는 부분이다. 특히 그러한 2단계의 인과관계 판단에서 경합원인이 존재하는 경우 준등가적인 원인이 아닌, 수치적으로 보아 상대적으로 낮은 원인도 낮은 원인도 중요한 원인이 될 수 있다는 점에 주의해야 한다. 끝으로 독일의 경우 인과관계의 증명은 원고가 해야 하는 것으로 보고 있고, 증명곤란의 경우 원고의 증명책임을 완화하기 위하여 그 증명도는 ‘의심할 여지가 없는 정도의 증명’을 요하는 것이 아니라 ‘충분한 개연성의 정도의 증명’이 필요한 것으로 해석하고 있다. 이 점은 우리의 실무와 유사한 부분이다.

Abstract

This article deals with occupational diseases and the proof of causation with a focus on the debate in Germany. In occupational or work-related diseases, causation is a key criterion for their recognition. However, it is often very difficult to prove causation. This is because occupational diseases often have a long incubation period or are caused by exposure to harmful factors over a long period of time, and are often caused not only by harmful work-related effects but also by pre-existing medical conditions or constitutional predispositions of casualties. In Germany, occupational diseases are regulated by Section 9 of the German Social Code Book (SGB) Ⅶ, which is based on the “limited enumeration principle,” supplemented by the regulation of quasi occupational diseases. The definition of what constitutes an occupational disease can be divided into two categories:the first category is referred to as the 'strict constituent facts of an occupational disease,' and the second category is referred to as the 'open constituent facts of an occupational disease.' In the former category, the minimum dose of exposure is specified and proof is required; in the latter category, this is not the case. Section 9 (3) also provides for a presumption of causation in order to reduce the claimant's burden of proof. In Germany, the Federal Social Court (BSG) rules that, in order to recognise an occupational disease, not only causation between the exposure and the disease, but also causation between the exposure and the performance of the work must be proved. This causation is showed in two stages:firstly, a causal link under the “but for test” (= conditio-sine-qua-non-formula) and secondly, a causal link under the “theory of the essential condition” (Wesentlichkeitstheorie). This contrasts with our practice of determining causation on the basis of “the proximate cause theory” (Adäquanztheorie). In particular, in two-step causal judgments, when there are competitive causes, it should be noted that causes that are not quasi-equivalent but numerically relatively low can also be important causes. Finally, in Germany, the burden of proof is on the plaintiff to prove causation, and in order to lighten the plaintiff's burden of proof in lack of evidence, the standard of proof is interpreted as “proof of sufficient probability” rather than “proof beyond a reasonable doubt.” This is similar to our practice.
