범죄예고 글에 대한 위협 평가 - 판결문 분석을 기반으로 한 특성과 유형 탐색

최근 대한민국 사회에 범죄예고 글이 급증하고 있으나, 그 특성에 관한 연구는 제한적이다. 이 연구는 발생 가능한 위험성을 분석하는 위협 평가(threat assessment)의 틀을 적용하여 범죄예고 글의 특성에 따라 유형화하였다. 먼저, 2023년부터 2024년까지 범죄예고 글에 유죄를 선고한 형사판결문 44건을 수집하였다. 형사판결문 44건에 대해 범죄예고 글의 특성에 따라 분류하고 이에 대한 군집분석을 실시하여 범죄예고 글의 유형을 추출하였다. 범죄예고 글은 속칭 ‘서현역흉기난동 사건’ 이후 급증한 것으로 나타났으며, 대다수 게시자가 주거지에서 누구나 접근 가능한 게시판에 범죄예고 글을 게시한 것으로 확인되었다. 군집분석으로 범죄예고 글의 유형을 분류한 결과 1) ‘표출형’, 2) ‘살인예비형’, 3) ‘관심유발형’으로 구분되었다. 1) ‘표출형’은 특정 사건으로 촉발된 분노나 불만은 근접할 수 없는 대상에게 단발적으로 범죄를 예고하는 특징을 보였다. 2) ‘살인예비형’은 가까운 대상에 대한 범죄의 의도를 가지고 오랜기간 범죄를 계획하여 범죄를 실현하기 위한 공격 관련 행동으로 나아가는 특징이 확인되었다. 3) ‘관심유발형’은 범죄 실현의 의도없이 관심을 유도하기 위한 목적으로 특정할 수 없는 대상에게 단발적으로 범죄를 예고하는 특징을 보였다. 도출한 범죄예고 글의 유형에 기반하여 범죄예고 글이 현실화될 수 있는 가능성에 대응하는방안을 제시하였으며, 연구의 한계와 의의를 논하였다.
Abstract
Recently, there has been a surge in crime threat posts in South Korean society; however, research on their characteristics remains limited. This study categorizes crime threat posts by applying the framework of threat assessment, which analyzes potential risks. A total of 44 criminal court judgment from 2023 to 2024, in which individuals were convicted for posting crime threats, were collected. Through cluster analysis, different types of crime threat posts were identified. The results indicate that crime threat posts have sharply increased following the so-called Seohyeon Station Incident, with most perpetrators posting such messages on publicly accessible online platforms from their residences. Cluster analysis revealed three types of crime threat posts. 1) Expressive Type: Posts triggered by specific events, in which individuals vent anger or frustration by making one-time crime threats against unattainable targets. 2) Murder Preparatory Type: Posts made by individuals with actual criminal intent toward specific targets, involving long-term planning and attack-related behaviors that may lead to crime execution. 3) Attention-Seeking Type: Posts made without genuine criminal intent, aimed solely at attracting attention by making crime threats against unspecified targets. Finally, this study discusses possible countermeasures for responding to crime threat posts, along with its limitations and implications.
