저개발국가는 지적재산권 보호를 강화할 정치적 유인이 있는가?

본 논문은 저개발국가의 경우, 혁신성장 및 해외직접투자 유치를 위하여 지적재산권 보호를 강화할 경제적 유인이 존재한다는 선행 연구를 기반으로, 지적재산권의 보호는 해당 국가 정치체제의 성격이라는 정치적 요인에 따라 다름을 주장한다. 저개발국가의 경우, 국내기업의 지적재산이 부재할 뿐만 아니라 국내적으로 활용되는 대부분 지적재 산은 해외기업 또는 외국인 소유이기에, 이에 대한 과세는 정치적 제약이 약한 세외수 입(non-tax revenue)의 효과가 있다. 본 논문은 저개발의 권위주의 국가는 지적재산권에 대한 보호를 강화하여 세외수입을 통한 재정 능력(fiscal capacity)을 확대할 정치적 유인 이 있다는 점을 제시하고, 경험적 분석에서는 선행 연구에서 제시된 해외직접투자 등과 같은 경제적 요인과 더불어 권위주의 공고화를 위한 수단으로써 지적재산권 보호라는 정치적 요인을 살펴보았다. 본 논문은 지적재산권 보호에 대한 저개발국가의 정치적 유 인은 저개발국가의 지속가능한 개발에 우호적이지 않음을 시사한다. 저개발국가가 권위 주의 정치체제를 유지하고 있는 경우, 지적재산권의 보호는 권위주의 정권의 공고화를 위한 도구로 사용되어 궁극적으로 지속가능한 개발을 위한 포용성, 개방성, 다양성을 저 해하는 결과를 가져올 가능성이 있다. 이에 따라 본 논문은 저개발국가의 지적재산권 제도는 민주화를 동반하지 않는 경우 혁신성장을 오히려 저해할 수 있음을 조심스럽게 제시한다.
Abstract
In the case of underdeveloped countries, this paper argues that the level of intellectual property protection varies depending on the nature of the country’s political system. Specifically, it contends that economically underdeveloped countries with authoritarian regimes have a political incentive to strengthen intellectual property rights protection for fiscal purposes. In the empirical analysis, the effects of economic factors, such as foreign direct investment, and political factors, such as authoritarianism, were examined. The paper suggests that the political incentives for underdeveloped countries to protect intellectual property rights may not align with these countries’ sustainable development goals. If an underdeveloped country maintains an authoritarian political system, the protection of intellectual property rights is likely to be used as a tool to solidify authoritarian regimes, ultimately undermining inclusiveness, openness, and diversity—key factors for sustainable development.
