초록
2022년부터 2024년까지는 대법원의 구성에 많은 변화가 있었다. 2023. 12. 8. 조희대 대법원장이 취임하였고, 9명의 대법관이 새로 임명되었다. 그럼에도 대법원은 여러 중요 판결들을 내놓았다. 그중에서 2022년 3건, 2023년 3건, 2024년 5건의 판결을 법철학적 관점에서 중점적으로 살펴보고, 몇 가지 주목할 만한 판결들을 간략히 정리하여 덧붙였다. 2022부터 2024년까지 선고된 다양한 대법원판결들은 우리 사회의 가장 첨예한 문제들과 정면으로 마주하고 있다. 사회적 소수자 문제, 군사독재 시기의 과거사 문제, 노동기본권 문제 등이 법적 논쟁의 장 속에서 검토되었고, 이러한 과정에서 법철학의 핵심적인 개념들이 대법원판결을 통해 제시되는 것을 확인하였다. 또한 체계적 해석, 역사적 해석, 목적론적 해석 등 법해석의 전통적인 규준들을 활용하면서 재정립하는 모습이고, 상충하는 이익의 균형, 입법과 사법의 경계 등 법해석론의 더 심층적인 차원에 관한 논의도 더욱 성숙되어 가고 있음을 보았다. 앞으로도 대법원판결을 법철학적으로 음미하는 작업을 통해 새로운 소재를 발견하고 공유하며 법철학의 탐구 영역을 확장해 가는 계기를 마련할 수 있기를 희망한다.
Abstract
From 2022 to 2024, many changes were made in the composition of the Supreme Court with Chief Justice Cho Hee-dae being sworn in on December 8, 2023 and nine Supreme Court justices being newly appointed. Nevertheless, the Supreme Court pronounced several important judgments. Among those, this paper will particularly examine three decisions made in 2022, three in 2023, and five in 2024 mainly from a legal philosophy perspective, and briefly summarize and add some other notable decisions. Various Supreme Court decisions handed down from 2022 to 2024 confront the most pressing issues in our society head-on. Issues such as social minority issues, past issues during the military dictatorship, and basic labor rights issues were examined in the legal debate, and core concepts of legal philosophy, in this process, were confirmed to be presented through Supreme Court decisions. In addition, this analysis demonstrates that discussions on deeper dimensions of the legal interpretation theory, such as the balance of conflicting interests and the boundary between legislation and the judiciary, have been maturing and that the traditional standards of legal interpretation, such as systematic interpretation, historical interpretation, and teleological interpretation, have been utilized and further reestablished. I purpose to continue the work of examining Supreme Court decisions from a legal philosophical perspective in hope of providing an opportunity to discover and share new issues and expand the scope of legal philosophy.
