본 연구는 북한 헌법의 최초 제정 과정에서 교통이 국유화 대상으로 법제화된 과정을 살펴보기 위해 진행되었다. 이를 통해 당시 철도 교통의 지위와 위치, 그 의의를 함께 살펴본다. 1948년 9월 북한은 독자적인 정권 수립을 위해 헌법을 제정·공포하였다. 이 과정에서 북한은 중요산업의 국유화를 헌법에 수록하면서 중요산업의 하나로 교통을 명시하였다. 오늘날 교통이라는 단어에는 여러 수단이 포함되어 있으나 당시 교통이라는 단어에서 가장 큰 비중을 차지하는 수단은 바로 철도였다. 그 이유는 철도가 남북을 통틀어 사실상 유일한 육상 교통수단이자 가장 활발히 이용되기 때문이었다. 따라서 북한은 철도를 그들만의 독자적인 정권 수립과 운영, 그리고 6·25전쟁 등 북한 정권의 유지와 정당성 획득을 위한 수단으로 활용하였다. 당시 남한에서도 북한과 마찬가지로 헌법에 교통의 국유화를 명시하였다. 이는 국가의 운영과 발전을 위한 주요 수단으로 철도를 위시한 교통의 중요성을 남한에서도 인식하였기 때문이었다. 양측이 이념적으로 큰 대립각을 세웠음에도 불구하고 공통적인 목소리를 냈다는 점은 매우 이례적인 일이다. 그러나 그 결과는 너무 달랐다. 남한이 철도를 비롯한 교통의 국유화를 언급한 이유는 바로 교통을 통해 자유민주주의 국가로 도약하기 위함이었다. 그러나 북한은 국유화라는 명분 아래 자신들의 통치를 정당화하는 수단으로 사용함은 물론 김일성 정권 유지를 위해 활용하였다. 이를 위해 북한은 철도 교통을 비롯한 중요산업의 국유화를 헌법에 명문화하였으며, 그 기조를 오늘날까지 유지하고 있다. 따라서 본 연구는 북한에서 맨 처음 헌법을 제정하는 과정에서 교통을 어떻게 인식하였고, 그것이 오늘날까지 어떻게 영향을 끼치고 있는지를 다루고자 하였다. 이를 이해하지 않고는 북한이 왜 오늘날까지 주철종도(主鐵従道) 형태의 교통 체계를 갖추고 있으며, 이것이 오늘날 북한 체제 형성에 어떻게 영향을 끼쳤는지를 알기 힘들다. 그리고 남북 교류가 활발할 때마다 왜 늘 철도가 거론되었는지, 그리고 향후 남북 교류는 어떤 면모로 접근해야 할지를 함께 연구하고자 하였다.
Abstract
This study was conducted to examine the process in which transportation was legislated as a subject of nationalization during the initial enactment of the North Korean Constitution. In September 1948, North Korea enacted and promulgated a constitution to establish an independent regime. North Korea included the nationalization of important industries in the constitution and designated transportation as one of the important industries. In addition, it utilized the railroad as a means to establish and operate an independent regime, and to maintain and gain legitimacy for the North Korean regime in the Korean War. South Korea has made a leap forward as a liberal democratic nation through transportation including railways. However, North Korea has used transportation as a means to justify its rule under the pretext of nationalization, and has also utilized it to maintain the Kim Il-sung regime. Therefore, this study aims to examine how transportation was perceived in the process of establishing the first constitution in North Korea and how it has influenced the present day. Through this, we aim to study why the railway has always been mentioned whenever inter-Korean exchanges are active, and how inter-Korean exchanges should be approached in the future.
