The military medical system plays a vital role in ensuring the health and welfare of soldiers serving in the armed forces. Article 10 of the Constitution of the Republic of Korea guarantees that "all citizens shall have dignity and worth as human beings and the right to pursue happiness," thereby affirming that soldiers, as citizens, are entitled to constitutional basic rights. Furthermore, Article 17 of the Act on the Status of Soldiers and Military Service stipulates that soldiers have the right to maintain their health and to receive appropriate and effective medical treatment for illnesses or injuries incurred during service. Article 6, Paragraph 1 of the Framework Act on Health and Medical Services also guarantees that all patients have the right to receive adequate health care services for the protection and promotion of their health. Therefore, if military medical services are insufficient or inefficient, issues of discrimination in relation to the general public may arise. In particular, soldiers are exposed to various risks during combat, training, and operational situations. The likelihood of disease or injury is higher compared to other occupations. Accordingly, ensuring adequate access to medical services, as well as prompt diagnosis and treatment, is essential. Moreover, active medical support from the state is necessary for diseases or injuries caused by such risks. However, problems within the military medical system persist. In the case of active-duty soldiers, the system is funded as part of the defense budget and faces limitations in medical resources, which may result in inadequate quality and accessibility of medical care. This can lead to delays in receiving necessary treatment, thereby affecting soldiers’ right to access medical care. Additionally, active-duty soldiers may experience restrictions on their right to self-determination in addressing personal health issues due to the unique nature of military service. They often lack freedom to access information about their health or to choose the medical services they need compared to other citizens. This situation may infringe upon their basic rights necessary for managing and promoting individual health. The issue of access to private medical institutions is particularly significant. Despite the shortcomings of military medical services and the comparatively limited capacity of private institutions, active-duty soldiers often face difficulties in utilizing private medical care due to complex procedures and restricted support. This leads to inadequate treatment and adversely affects their health. As soldiers performing special duties, they are entitled to the right to access optimal health care services necessary to protect and enhance their own health. Therefore, it is essential to improve related procedures and policies to enable effective use of private medical institutions. Through these measures, the military medical system’s overall performance can be enhanced by guaranteeing soldiers’ rights to medical access and self-determination and by providing efficient medical care. The improvement of the military healthcare system not only enhances the health of individual soldiers but also significantly impacts the overall combat readiness of the armed forces. If soldiers continue to be deprived of adequate medical treatment, it could adversely affect national defense stability. Therefore, reviewing the military healthcare system is crucial, as it concerns not only the enhancement of individual soldiers’ medical services but also directly relates to national security. This study aims to examine the rights to medical access and self-determination within the military healthcare system, and to explore the procedures and policies related to soldiers’ use of civilian medical institutions, specifically focusing on the military civilian hospital medical expense support system, to ensure that these fundamental rights are adequately protected.
