小溪 박재섭(朴在灄) 선생의 삶과 국제법 —평화를 추구한 법규범론자—

The purpose of this article is to describe the life of Professor Pak, Zai- Sup, who dedicated a lifetime education at the Faculty of Law (currently School of Law), Korea University, and also to evaluate his world of international law. The implication of this article can be as follows: first, to recall the merits and efforts of the former professor who established the discipline of international law at Korea University; secondly, to review how and in what fields academic research, after the decolonization from Japan and until 1970s, were done in a barren climate where the acquisition of new materials of international law from outside were hardly difficult. Such reviews and evaluations will certainly have implications for current and future scholars. Professor Pak, Zai-Sup was born in 1916 and passed away in 2012 at the age of 96. He was one of the first generation of Korean jurists after the decolonization from Japan, and worked hard for academic research and development in the field of international law as a professor at the Faculty of Law, Korea University over 30 years from March 1948 until his retire- ment. Professor Pak, Zai-Sup obtained his doctorate in law from Korea University in 1963 under the title “The Status of War in International Law: Starting from the Outbreak of World War I,” and was published as a monograph titled “War and International Law” in 1964. Professor Pak, Zai-Sup's research field is mostly focused on the law of war, but he also wrote articles, case reviews, and book reviews on legal theory, human rights, and the outer-space law. In addition, it should be underlined the famous academic debates with Professor Lee, Han-Ki who was, at that time, a Professor at Seoul National University. The origin of debate was a book review written by Professor Lee about Professor Pak’s doctoral dissertation “War and International Law,” but the debate was expanded to essential aspects of international law. That ground debates continued over two years 1964-1965 and it remains until now as a famous and unique academic incident in the history of the Korean Society of International Law. In sum, Professor Pak, Zai-Sup was a scholar who constantly researched, and who inspired his students and showed the right path what scholars should follow. If a scholar were to be evaluated by his or her personal character and research achievements, the author clearly agrees that Professor Pak, Zai-Sup was one of great scholars in Korea, and he was the person most respected by his students in terms of personality.
