국선변호인제도의 개선방향에 대한 고찰 - 법령과 입법 시 고려사항을 중심으로 -

The public defender system goes equality of arms and has the nature of a social right. In order to operate the system smoothly, sustainability and realization are important. The public defender system was significantly revised in 2006, and the trend of quantitative expansion based on limited considerations has been maintained. This trend has become impossible to maintain due to increased life expectancy, the emergence of new socially vulnerable groups, and major changes in the legal environment. The public defender system must be sustainable, providing faithful and accurate assistance. At the stage of acts, the subjects and scope of necessary public defenders must be adjusted, and the authority of public defenders must be specifically defined. This includes the selection system subject to the provision of collateral, selection of public defenders by consent, reorganization of reasons for resignation, and stipulation of the public defender system. In addition, a stable foundation for operation is necessary, such as organizing compensation rate standards and forming a special account. In lower-level systems, selection guidance and compensation-related matters must be organized more realistically, and the selection and operation of public defenders must be diversified. In order for public defenders to continue their work, support is also needed for ensuring their safety and recovery.
