정신장애 범죄자의 심신장애 판단구조에 관한 소고 -일본의 책임능력 판단구조를 중심으로-

정신장애 범죄자에 대한 심신장애 판단은 규범적 판단을 요하는 영역이다. 법관은 의학적 감정결과에 구속되지 않고 사물변별능력 및 의사결정능력의 유무에 관한 판단을 범행동기와 경위 등 관련 모든 요소를 종합하여 경험칙에 비추어 독자적으로 규범적 평가를 한다. 그러나 사람의 정신상태를 판단하는 일은 고도의 전문성이 있어야 하는 영역이다. 또한 심신장애 판단은 단순히 정신장애가 의심되는 사람이 저지른 범죄를 다루는 것이 아니라 정신장애가 범죄의 원인인가라는 질문에 답을 찾아가는 과정이다. 따라서 심신장애 판단이 종국적으로 법관이 독자적으로 평가하는 법적 영역임을 부인할 수 없다고 하더라도, 법적 개념인 심신장애라는 규범적 판단이 정당성과 설득력을 얻으려면 행위자의 정신상태에 대한 정확한 진단이 선행되어야 한다. 이때 심신장애 판단의 핵심은 정신질환의 진단에 있는 것이 아니라 특정 정신장애에서 발현되는 증상이 범행에 미친 영향을 파악하는 것이다. 그런데 실무에서 심신장애 판단을 위한 조사 방법 중 피고인의 범행 이전의 과거력의 활용도가 높은 것으로 나타났으며, 정신감정도 정신질환 진단에 사용되는 일반적인 진단평가를 내용으로 한다는 점에서 형사 정신감정에 특화되어 있다고 보기 어렵다는 비판이 있다. 따라서 심신장애 판단에 법관의 독자적·규범적 판단이 자의적 판단이 될 위험성을 완화할 장치가 필요하다. 법학과 정신의학 영역에서 서로 비전문가인 법관과 정신의학 전문의의 협업이 중요하면서도 그 역할 분담의 체계화, 즉 감정인이 어디까지 의견을 개진할 것인가 하는 선 긋기에 대한 논의가 요구된다. 일본에서 정신과 의사가 책임능력에 대해 어디까지 언급하고 법관이 어디까지 그 의견을 존중할 것인지는 오랜 현안 사항이었다. 형사책임능력을 ‘어느 쪽’이 결정할 것인가 하는 판단 주체의 논의가 아니라 형사책임능력을 ‘어떻게’ 정하는가 하는 판단구조나 과정이 중요하다는 문제 인식하에 정신의학과 형사 법학의 학제적 연구가 상당히 이루어져 왔다. 즉 법률가와 감정인의 협업 과정의 구조화, 정신감정 서식의 표준화를 통해 심신장애 판단의 타당성과 정신감정의 신뢰성 확보를 위해 노력해 왔다. 심신장애 판단은 정신의학과 형사 법학이 교차하는 지점으로 상호 간 효율적인 협업을 통해 심신장애 판단 과정의 신뢰성을 높여야 심신장애 판단이 정당성을 얻을 수 있다. 이런 점에서 이 글에서는 이들 상호 간 효율적 협업을 통해 심신장애라는 법적 판단의 신뢰성을 담보하기 위해 다양한 방안을 모색하고 실천해 가는 일본의 사례를 검토하고 시사점을 도출하였다.
Abstract
The Judgment of criminal responsibility for offenders with mental disorders falls within the realm of normative judgment. Judges are not bound by medical expert opinions and independently make normative assessments based on their own experiences, taking into account all relevant factors such as the motive and circumstances of the crime to determine the offender’s capacity for understanding and decision-making. However, assessing a person's mental state is an area that requires a high degree of expertise. Moreover, determining criminal irresponsibility due to mental disorder is not simply about handling crimes committed by individuals suspected of having mental illness, but rather about answering the question of whether the mental disorder was the cause of the crime. Therefore, although it is undeniable that the legal determination of criminal irresponsibility ultimately falls within the judge’s discretion, such a normative judgment—being a legal concept—must be preceded by an accurate diagnosis of the offender’s mental state to be legitimate and persuasive. In this context, the core of the assessment lies not in diagnosing a specific mental disorder, but in understanding how symptoms manifested by that disorder influenced the criminal act. In practice, however, investigations for determining criminal irresponsibility tend to rely heavily on the defendant’s history prior to the offense. Additionally, psychiatric evaluations often follow general diagnostic procedures used for medical purposes, which has led to criticism that they are not specialized for criminal cases. This raises concerns that judges’ independent normative assessments could become arbitrary. Therefore, mechanisms are needed to mitigate such risks. Collaboration between judges—who are legal professionals—and psychiatrists—who are experts in mental health—is essential, and there is a need to systematize the division of roles, particularly the scope of opinions that psychiatric experts should offer. In Japan, the issue of how far psychiatrists should speak on criminal responsibility and to what extent judges should respect their opinions has long been a matter of debate. Rather than focusing on who should determine criminal responsibility, the emphasis has shifted to how the process should be structured. Interdisciplinary research between psychiatry and criminal law has been actively pursued under this awareness. Efforts have been made to ensure the validity of criminal irresponsibility assessments and the reliability of psychiatric evaluations through the structuring of collaborative processes between legal professionals and psychiatric experts, as well as through the standardization of psychiatric evaluation formats. The determination of criminal irresponsibility lies at the intersection of psychiatry and criminal law. Its legitimacy depends on enhancing the credibility of the evaluation process through efficient collaboration between these two fields. This article, therefore, examines Japan's case as a reference and draws implications by exploring the various measures implemented there to ensure the reliability of legal judgments on criminal irresponsibility through such interdisciplinary collaboration.
