탄소중립과 신재생에너지 확보를 위한 산림바이오매스 법제 개정 방향

초록
산림바이오매스 정책은 경제성 확보가 가장 중요한 관건이 된다. 투입비용 대비 얻어지는 경제적 이익이 더 크거나 적어도 같다면 의미가 있다. 충분하고 지속적인 양의 산림바이오매스를 확보하고, 일정한 지역단위로 수집부터 소비까지 순환되는 체계를 구축한다면 경제성 확보가 가능하다. 산림바이오매스 정책은 임업과 농산촌 발전, 에너지 수급 자급자족, 지속가능한 에너지 순환 이용 체계 구축, 일자리 창출, 산림관리 체계의 일대 혁신 등 한국 사회에 큰 변화를 가져올 수 있다. 산림바이오매스의 잠재적 가치, 종사자 규모, 탄소저감 효과, 전국적 관리 체계 구축 필요성 등을 두루 고려해 볼 때, 산림바이오매스 관련 법제는 단계적으로 구체화할 필요가 있다. 이 논문은 산림기본법과 목재이용법 두 법률을 대상으로 개선 방향을 제시하였다. 우선 산림기본법 제6조, 제11조, 제17조, 제20조의2에서 각각 산림바이오매스의 중요성이나 이용 활성화 당부 취지를 명시해야 한다. 이어서 목재이용법 제2조에서 산림바이오매스의 의미를 다시 정의할 필요가 있다. 또한 목재이용법 제6조에서 목재만이 아니라 기타 목질계 산림바이오매스에 대해서도 종합계획을 함께 수립하도록 명시해야 한다. 그리고, 목재이용법 제6장 부분에 조를 신설하여 지역 중심의 산림바이오매스 자원순환 체계를 구축하도록 하는 내용을 명시할 필요가 있다. 이 정도의 개정을 기반으로 정책을 추진한 후, 사회적으로 산림바이오매스 정책의 중요성이 어느 정도 확산되면 현행 목재이용법으로부터 분법화하여 산림바이오매스 이용 활성화에 관한 법률을 제정하면서 지역 중심의 자원순환 체계 등을 더욱 구체화하고, 아울러 신․재생에너지법제와의 연계성도 구체화해야 한다.
Abstract
The most crucial factor for forest biomass policy is achieving economic viability. The policy is meaningful only when the economic benefits obtained outweigh, or at least equal, the input costs. If a sufficient and sustainable supply of forest biomass can be secured and a regionally based system for its collection and consumption can be established, then economic viability can be attained. Forest biomass policy has the potential to bring significant changes to Korean society, including the development of forestry and rural areas, energy self-sufficiency, the establishment of a sustainable energy circulation system, job creation, and a major transformation in forest management practices. Considering the potential value of forest biomass, the size of its workforce, its carbon reduction effects, and the need for a nationwide management system, it is necessary to gradually elaborate the legal framework related to forest biomass. This paper proposes directions for improvement focusing on two laws: Forest Basic Act and Wood Utilization Act. First, the importance and the policy aim of promoting the use of forest biomass should be explicitly stated in Articles 6, 11, 17, and 20-2 of the Forest Basic Act . Next, the definition of forest biomass in Article 2 of the Wood Utilization Act needs to be revised. Furthermore, Article 6 of the same Act should be amended to require the establishment of a comprehensive plan not only for timber but also for other types of woody forest biomass. In addition, a new chapter should be added to Chapter 6 of the Act to stipulate the establishment of a regionally based forest biomass resource circulation system. Once policy is implemented based on these revisions and public awareness of the importance of forest biomass increases, a new, separate law—tentatively titled the Act on the Promotion of Forest Biomass Use—should be enacted. This law would further specify regionally centered resource circulation systems and clarify connections with renewable energy laws and regulations.
