2024년 헌법재판소 결정에 의해 유류분 제도의 유연화는 시급한 과제가 되었으며, 유연화의 대표적인 수단 중 하나인 유류분의 사전포기계약이 입법화될 가능성이 높아졌다. 유류분의 사전포기계약은 피상속인으로 하여금 장래 유류분 분쟁에 대한 우려 없이, 가족구성원의 다양한 필요를 고려하면서, 자신이 가장 적절하다고 생각하는 대로 상속재산을 처리하는 것을 가능하게 하는 제도이지만, 유류분 제도의 본질적 내용을 침해할 수 있다는 우려 때문에 그 도입에 대해 비판적인 견해들이 있었다. 이 논문은, 원래 상속계약 및 상속포기계약을 인정하고 있었으며, 상속포기계약의 한 유형으로서 유류분 사전포기계약을 인정하는 독일과 오스트리아의 법제도를 검토하고, 원래 상속계약을 인정하지 않았으나 예외적으로 유류분 사전포기 계약을 도입한 프랑스, 이탈리아, 일본의 법제도를 개관한다. 이로써 유류분 사전포기 계약을 도입했을시 예상되는 문제점, 그리고 각국의 법제가 이 문제에 어떻게 대처하고 있는지 연구하여, 우리 민법 개정에 유용한 시사점을 제공하는 것을 목표로 한다.
Abstract
The decision of Constitutional Court in 2024 makes it urgent that the compulsory share system be reformed, and one of the most prominent means of reform is the legislation of renunciation of compulsory share. While renunciation agreements allow testators to dispose of their estate as they see fit, taking into account the various needs of family members, without fear of future disputes over the estates, there have been some critics of their introduction due to concerns that they may infringe on the essential content of the compulsory share system. This article examines the legal systems of Germany and Austria, which originally recognized inheritance contracts and renunciation agreements, and which also recognize renunciation of compulsory share, as well as the legal systems of France, Italy, and Japan, which originally did not recognize inheritance contracts but have introduced renunciation of compulsory share as an exception. This article aims to provide useful implications for the revision of Korean Civil Code by studying the problems that may arise from the introduction of renunciation agreements and how the legal systems of these countries deal with them.
