학교구성원 인권 보호를 위한 통합적 접근

최근 학교 현장에서 종종 벌어지고 있는 교사들의 극단적 선택을 계기로 학생인권과 교사인권과의 충돌 문제가 사회적 갈등의 한축을 이루며 논란이 되고 있다. 이러한 논란의 한편에서는 교사들에 대한 인권침해를 초래한 이유로 그동안 학생인권만을 강조함으로써 발생한 문제라거나 그 근거로 이용되는 학생인권조례를 탓하기도 한다. 그러나 이러한 주장에는 경계해야 할 점이 많이 있다. 교사의 인권과 학생의 인권은 결코 충돌‧대립되는 것이 아니고, 양자택일적 관계에 있는 것도 아니다. 학생인권과 교사 인권의 충돌 사례로 제시되는, 학생에 의한 교사 폭행이나 수업 방해, 교사에 대해 학부모의 도를 넘는 괴롭힘 등 행위는 학생인권 보호 문제와는 또 다른 차원으로 분리하여 접근할 필요가 있다. 학생의 권리와 교사의 권리가 상호 연관되고 상호 의존 관계에 있음을 인식하고 상호 보완적 관점에서 문제의 해결 방안을 모색하는 것이 필요하다. 학생의 인권뿐만 아니라 교사의 권리를 함께 보장하고, 또한 각 구성원의 권리 행사에 따른 책임을 명확히 규정함으로써 다른 사람의 권리를 존중하고 보호하는 대책을 정부 정책 차원에서 마련하는 것이 시급한 것이다. 학생, 보호자, 교원이 각자 자기 권리만 주장할 것이 아니라 다른 구성원의 권리도 존중하고 보호하면서, 권리에 따른 책임을 충실히 이행하는 인권 친화적 학교 문화를 형성하고, 학교생활 속에서 서로 인권을 존중하고 보호하는 경험을 제공하기 위해서는 학생, 보호자, 교원에 대한 권리 교육 및 책임 교육을 병행하고, 미흡한 제도에 대해서는 적극적으로 보완해 나갈 필요가 있다. 본 논문에서는 이런 관점에서, 학생인권 보호와 교사인권 보호 관련하여 논란이 되고 있는 부분에 대한 해결책을 찾기 위해 각 학교구성원의 권리와 책무에 대해서 규범적 분석을 시도하고, 이러한 분석을 바탕으로 학생과 교사 뿐만 아니라 보호자 등을 포함하는 학교구성원 인권 보호를 위한 통합적 접근을 통해 양자가 공존 상생할 수 있는 제도적 보완책을 강구하고자 한다.
Abstract
Recently, the issue of conflict between student human rights and teachers' human rights has been controversial as an axis of social conflict in the wake of the occasional suicide of teachers in the school field. On the one side of this controversy, the situation of human rights violations against teachers has been blamed on the enactment of the Student Human Rights Ordinance or has been caused by emphasizing only student human rights. However, there are many things to be cautious about these arguments. The human rights of teachers and the human rights of students never collide or confront, nor is there an alternative relationship. Assaults against teachers and obstruction of classes by students, and bullying by parents, presented as examples of conflict between student human rights and teachers’ human rights, need to be approached on a different level from the issue of protecting student human rights. It is necessary to recognize that the rights of students and teachers are interrelated and interdependent, and to find solutions to the problem from a complementary perspective. It is socially required to respect and protect the rights of others by guaranteeing not only the human rights of students but also the rights of teachers and clearly defining the responsibilities of each member's exercise of rights. In order to form a human rights-friendly school culture in which students, guardians, and teachers respect and protect the rights of other members and faithfully fulfill their responsibilities according to rights, and to provide experiences of respecting and protecting human rights in school life, it is necessary to provide rights and responsibility education for students, guardians, and teachers at the same time, and to actively supplement insufficient systems. From this point of view, this paper attempts a normative analysis of the rights and responsibilities of each school member to come up with a solution to the problem of protecting student human rights and teachers' human rights, and based on this analysis, I intend to devise institutional supplementary measures to coexist through an integrated approach between student human rights and teachers' human rights.
