인공지능 그림 저작물 분쟁에 관한 법적 연구

초록
생성형 인공지능 산업은 기초숙련노동 분야를 빠르게 파괴해 나가고 있고 그 중 가장 극적으로 노동시장이 무너지고 있는 분야 중 하나가 미술 저작물 분야 중 그림이라 할 것이다. 그 중에서도 Midjourney, DALL·E, Stable Diffusion과 같은 인공지능 소프트웨어의 산출물은 학습데이터가 방대하여 이미지의 수준도 상당히 높아 모든 화가와 디자이너의 숙적이라고 불리는 제너레이터이다. 특히 미드저니의 2022년 콜로라도 주립 박람회(Colorado State Fair) 미술 대회 Théâtre D'opéra Spatial (우주 오페라 극장) 우승사건은 비록 상금은 300 달러로 당시 40만원에 불과하였지만 디지털 아트 부문 1등을 차지한 부분에 대해 단순한 미술 대회 논란을 넘어, "AI가 창작의 주체가 될 수 있는가?" 라는 중요한 철학적, 법적, 사회적 질문을 던진 계기가 되었다. 이에 본 논문에서는 II. 인공지능 그림 저작물의 저작자 논란과 이에 대한 입법방향을 살펴보고 III. 인공지능 그림 저작물의 2차적 저작물 논란과 AI 아트 시장의 미래에 대해 연구해보고자 한다.
Abstract
The generative AI industry is rapidly destroying the basic skilled labor sector, and one of the fields where the labor market is collapsing most dramatically is the field of art works, paintings. Among them, the output of AI software such as Midjourney, DALL·E, and Stable Diffusion is called the nemesis of all artists and designers, as the learning data is massive and the image quality is also quite high. In particular, Midjourney's victory in the 2022 Colorado State Fair art contest Théâtre D'opéra Spatial (Space Opera Theater) went beyond the simple art contest controversy, but it became an opportunity to ask important philosophical, legal, and social questions such as "Can AI become the subject of creation?" in terms of winning first place in the digital art category, even though the prize money was only $300, which was only 400,000 won at the time. In this paper, II. We will examine the copyright controversy of AI paintings and the legislative direction for this, and III. We will study the controversy over secondary copyright of AI-based artworks and the future of the AI art market.
