초록
교제폭력 사건의 경우 수차례의 112신고에도 불구하고 결국, 피해자가 살해되는 등 교제폭력 피해사례가 연일 심각한 모습으로 언론을 통해 보도되고 있다. 교제폭력을 규정하고 있는 법, 제도가 부재한 상황에서 이러한 피해로 인해 국민의 생명을 보호하는 핵심역할 기관인 경찰조직으로서는 당혹스러움을 감출 수가 없는 상황이다. 현장경찰관은 교제폭력의 특성을 명확히 이해하고 현장 초동조치 시 ‘스토킹범죄’ 등 교제폭력과 수반하여 일어날 수밖에 없는 필요적 범죄에 대한 면밀한 확인이 요구되고 있다. 법안 마련과 함께 교제폭력에 대한 경찰관의 인식 전환과 전문성 함양, 그리고 지역주민의 협력과 범죄에 대한 폐해 등 관련 정보를 공유·홍보하여 범죄와 그에 따른 2차 피해를 예방하여야 할 것으로 보인다. 아울러, 경찰관 개인역량에 따라 국민의 생명 보호가 큰 영향을 받게 해서는 안 될 것이다. 따라서 살인 등 강력범죄의 전 단계인 교제폭력 범죄로 인한 피해를 예방하기 위해서는 경찰관의 전문성 확보 등 다양한 개선방안 등을 검토해 보아야 할 필요가 있다. 이에 본 연구에서는 교제폭력의 현황과 이론적 배경을 살펴본 후 선행연구와 함께 법, 제도적 개선방안에 대한 부분을 주요내용으로 범죄현장에서의 문제점과 그에 대한 여러 가지 개선방안 등을 제시함으로써 경찰 교육에 반영하여야 할 내용들을 짚어보았다.
Abstract
In the case of relationship violence, despite several 112 reports, victims are eventually murdered, and serious relationship violence cases are being reported through the media every day. In the absence of laws and systems that regulate relationship violence, the police organization, which is a key organization that protects the lives of the people, cannot hide its embarrassment due to such damage. Field police officers are required to clearly understand the characteristics of relationship violence and closely check for necessary crimes that inevitably occur along with relationship violence, such as ‘stalking crimes’, when responding to initial actions on the scene. Along with the preparation of the bill, it seems necessary to change the perception of police officers on relationship violence, foster their expertise, and share and publicize related information on the cooperation of local residents and the harmful effects of crimes to prevent crimes and secondary damages. In addition, the protection of citizens' lives should not be greatly affected by the individual capabilities of police officers. Therefore, in order to prevent damage caused by relationship violence crimes, which are the prelude to serious crimes such as murder, it is necessary to review various improvement measures such as securing the expertise of police officers. Accordingly, this study examined the current status and theoretical background of relationship violence, and then presented problems at crime scenes and various improvement measures, focusing on previous research and legal and institutional improvement measures, thereby identifying the contents that should be reflected in police education.
