자율주행자동차 도입실현 확대를 위한 도로교통 안전 법제 환경 정비 방안 - 일본 도로교통법 개정안을 중심으로 -

초록
4차 산업혁명시대 도래와 AI 기술 발전 등에 따른 관련 영역과 저변확대에 따라 교통에도 파생되는 사항들이 상당하다. 교통수단의 기술 발전은 여러 가지를 가능하게 해 주는 이점을 주고 있다. 자율주행 기술은 발전을 거듭하면서 상상을 넘어 눈앞의 현실로 되어 확대를 앞두고 있다. 도로교통법은 자율주행 실현과 안전 확보에 있어 중요한 법제이다. 한국은 현재 레벨3 대응이 가능한 자율주행 관련 도로교통법이 시행중이다. 그렇지만 자율주행 실현 확대를 위해서는 관련법 개정이 계속되어야 한다. 일본은 도로교통법 개정을 통하여 자율주행 확대 실현을 위하여 레벨4 이동서비스 대응을 위한 도로교통 안전성 확보 법제 방안 마련을 단계적으로 이어가고 있다. 한국의 도로교통법과의 유사성 등을 고려하였을 때 한국의 상황에서는 관련 법제 검토는 의의가 있다. 일본은 도로교통법에서 특정자율주행 허가제, 특정자율주행 실시자와 주임자 등을 지정하여 도로교통의 안전성 확보를 위한 다양한 법제를 입법화하였고 유관한 법령에 대한 사항도 고려하여 실현을 위한 노력을 하였다. 이는 특정자율주행에 따른 본격적인 도로교통 환경의 변화 추진을 위한 법제 마련의 일환이라 할 수 있다. 특히 위해 방지 관점으로부터 도로교통 상의 안전성을 확보하기 위한 것이다. 또한 이는 자율주행 실현 확대를 위해 개정이 필요한 한국의 도로교통법에도 시사점이 될 것이다. 이러한 상황에 비추어 본다면 자율주행자동차가 처음 언급되었을 때 막연히 사람의 역할이 완전히 사라질 것이라는 생각에서 벗어나 실질적 실현 확대를 위한 다양한 도로교통 안전법제 환경정비 방안에 대해 숙고한 계획을 구체화하기 위한 지속적인 논의·검토로 안전하고 실질적인 자율주행 자동차 도입실현 확대가 이루어질 수 있도록 다양한 노력을 이어가야 할 것이다.
Abstract
The emergence of the Fourth Industrial Revolution and the rapid advancement of artificial intelligence (AI) technologies have led to significant expansion in related fields, including transportation. Technological progress in this sector provides numerous advantages, enabling new possibilities. Automatic driving technology has evolved to the point where it has become a tangible reality, with its widespread implementation approaching. The Road Traffic Act serves a vital role in ensuring the realization of automatic driving while maintaining road safety. South Korea currently enforces the Road Traffic Act, which supports Level-3 automatic driving. However, further amendments to related legislations are essential to facilitate the broader implementation of autonomous driving. Japan, for instance, has systematically introduced legal measures to ensure road traffic safety, amending the Road Traffic Act to support Level 4 mobility services. Given the structural similarities between the Road Traffic Acts of South Korea and Japan, reviewing and adapting South Korea's legal framework is a matter of critical importance. Japan has enacted various legislations aimed at securing road traffic safety, including a specific automatic driving permit system and the designation of automatic driving operators and supervisors. In addition, efforts have been made to integrate relevant legislative considerations to support the successful realization of autonomous driving. These amendments constitute a broader legislative strategy to reshape the road traffic environment, primarily focusing on ensuring safety from a hazard prevention perspective. These legislative developments in Japan provide essential insights into the amendments required in South Korea's Road Traffic Act to further facilitate the introduction of autonomous driving. Moving beyond early assumptions that Autonomous Vehicles would eliminate human roles entirely, it is crucial to engage in ongoing discussions and systematic analysis of legal frameworks that prioritize road traffic safety for the full-scale implementation of autonomous vehicles. Through structured legal planning and continuous revisions, ensuring a safe and practical expansion of automatic driving remains a key priority.
