비대면 AI 스포츠코칭 시스템 개발의 이슈와 대응전략 : 의료법을 중심으로

This study aims to analyze the legal issues arising from the rapid expansion of contactless AI-based sports coaching systems following the COVID-19 pandemic and to propose appropriate policy response strategies. As AI technology advances, sports coaching has increasingly incorporated features such as personalized exercise programs, real-time posture correction, and biometric data analysis. However, these developments have blurred the distinction between traditional medical practices and general health services. This study investigates whether certain functions of AI sports coaching systems may be classified as unauthorized medical practices or infringe upon legal restrictions on remote medical services under the current Medical Law. It also explores potential conflicts with other relevant legislation, including the Personal Information Protection Act. A qualitative legal analysis was conducted through a review of existing statutes, official guidelines, and judicial precedents. The findings suggest that if AI sports coaching systems evaluate users’ health conditions or provide therapeutic recommendations, such functions may fall within the scope of medical practice. Additionally, there is a potential risk of non-compliance with regulations concerning the handling of sensitive personal information. In response, the study proposes several policy strategies: clarifying the legal boundary between medical services and general health management, strengthening measures for personal data protection, defining the legal responsibilities of service providers, and promoting government-led institutional support. These recommendations aim to enhance the safety, legality, and long-term viability of AI-driven sports coaching services.
