기후위기 대응에 있어 형벌의 한계와 대안에 대한 소고

기후변화 대응은 국민의 기본권 보장을 위한 국가 의무 이행과 직결되는 문제로 국가의 핵심 과제로 정책적・법적 노력이 계속되고 있다. 법적인 측면에서는 관련 행정법 제정 및 개정과 환경형법이 제시된다. 환경형법은 보호법익불명확성, 형법 원칙에 대한 견해 대립, 행정법 종속성 등과 같은 한계로 인하여 유일무이한 대안이 아니라 오히려 형벌만능주의와 정당성에 관한 문제가 제기될 수 있다. 현재 우리나라 법제는 기후변화 원인 행위자에 대한 형사처벌규정도 있지만 행정제재를 중심으로 하며 특정 기준 내에서의 행위는 용인한다. 따라서 기후변화 대응에 위반하는 행위에 대해 범죄화 여부와 행정 제재에 의한 대안 가능성이 검토되어야 한다. 기후변화 대응 위반 행위인 탄소범죄를 형법전에 규정하는 것은 의미 있지만 환경형법의 문제를 고려하면 실효성을 장담할 수 없다. 이러한 이유에서 본고는 탄소범죄는 예방이 중요한 점에서 범죄 발생 사후에 응보는 적절하지 않다고 보았다. 이에 대한 한계를 개선하기 위해 탄소중립기본법 과 동시행령 개선방안을 제시하고 나아가 기후변화 원인 제공 행위자에 대하여 전면 범죄화(자연범)보다 행동경제학을 적용하여 국민과 기업의 행동에 영향을 미쳐 범죄 실행의 착수로 나아가지 않는 방안을 제시하였다.
Abstract
This study addresses the limitations of incorporating carbon crimes—violations of climate change obligations—into the criminal code, considering structural challenges in environmental criminal law such as ambiguity in protected legal interests, subordination to administrative law, and debates on the legitimacy of punishment. While Korea imposes some criminal penalties for climate-related conduct, the current framework primarily relies on administrative sanctions and allows actions within specified thresholds. Recognizing that punitive measures are often inadequate for the inherently preventive nature of environmental harm, the study proposes alternative approaches. Specifically, it suggests revising the National Strategy for National strategy for carbon neutrality and its enforcement decrees to strengthen regulatory effectiveness. Drawing on behavioral economics, the paper advocates influencing individual and corporate behavior preemptively, aiming to prevent environmentally harmful conduct from occurring in the first place. This approach seeks to enhance compliance while avoiding the drawbacks of over-reliance on criminal punishment.
