인공지능시대의 노동법적 과제에 관한 소고:경제학, 사회학 및 법학 학제간 연구를 통하여

With the rapid development and dissemination of generative AI, there is growing interest in how the advancements in technology, represented by generative AI, and the automation it enables will impact society and the economy. On the one hand, generative AI technology is expected to address various future social challenges, such as improving productivity (augmentation) and added value, and solving the issue of a declining labor force. On the other hand, it is anticipated that generative AI technology will affect almost all jobs in the future, with a particular possibility of automation in high-income professional jobs. This raises concerns about the potential for mass unemployment and widening economic disparities. In response to the changes in the labor market due to AI, extensive preparation is required. This paper aims to derive labor law challenges, particularly focusing on legislation. First, it reviews the recent macroeconomic analyses from abroad regarding the potential disappearance of jobs due to the rapid development of AI (Ⅱ). Then, it examines the contents of a survey conducted to identify more micro-level issues that may arise at each stage of employment, including job loss, due to the adoption of AI in South Korea (Ⅲ). Finally, it analyzes the current labor law regulations in South Korea and the challenges at each stage of labor relations, based on overseas cases that are proactively addressing the same issues from a labor law perspective(Ⅳ).
