2025년 5월 고려대학교 법과대학은 개교 120주년을 맞이하였다. 이 글은 개교 100주년(1905년-2005년까지)에 대한 선행 연구에 이어서 2005년부터 2025년 현재까지 고대 법대 상법학의 발자취를 살펴보는 것을 목적으로 한다. 돌이켜보면 2005년 이후는 실로 한국의 법학연구와 법학교육에 있어 새로운 도전과 변화를 가져오는, 그야말로 중대한 전환기의 시기였다. 학부 법학교육의 토대 위에서 사법시험을 거쳐 법률가를 선발하는 체제에서 미국식 대학원 체제를 통한 법률가 양성교육으로 전환하게 되면서 법학과를 폐지하고 법학전문대학원이 출범하였기 때문이다. 고려대학교 법과대학과 법학전문대학원이 걸어온 지난 20년의 도전과 변화의 시기에 상법학을 중심으로 살펴본 결과 고려대학교가 추구한 인간상인 “지성과 야성을 겸비한 전인적 인간"상을 구현하기 위해 끊임없이 다양성을 추구하였고 경쟁을 통해 학문적 자유의 아카데미아이기를 열망하여 왔음을 확인할 수 있었다. 2005년 이후 2025년까지를 회고하면서 느낀 것은, 고대 법대 상법학의 명예교수님들은 매 순간 진지하게 상법학 학문을 추구하였고 그러한 열정만큼 법적 쟁점에 대한 학설과 법리 앞에서 치열하게 경쟁하고 또 뜨겁게 화합하였다는 점이다. 다가오는 미래는 다시 지나간 과거가 되어 그 이전의 역사로 이어진다. 우리가 과거의 역사를 되돌아보는 것은 고대 상법학의 발전방향과 미래를 그리는 설계를 제시하는 계기로 삼기 위해서이다. 고대 상법학의 다가올 새로운 100년의 역사를 새롭게 열어 가기 위하여 마음을 가다듬고 정신을 한데 모아야 할 시점이다. 고대 법대의 영광스러운 지난 날의 성취에 자만하지 않고, 치열한 경쟁 속에서 끊임없는 도전에 대비하여야 하며, 외국의 법이론을 도입하고 단순 모방하는 단계를 넘어 우리 생활과 전통에 기초한 법감정에 맞는 법문화를 만들어 내야 하는 시대적 과제를 생각해야 할 때이다. 더구나 법학전문대학원 제도의 도입으로 깊이 있는 법학연구보다는 법률실무가 양성에 교육의 중점이 옮겨진 이상 교육이라는 과제도 소홀히 할 수 없다. 다시 한번 새롭게 도약하여 새로운 100년을 맞이할 때에는 세계의 법학계, 세계의 법률시장을 주도하는 고대법학의 상법학이 되기 위해 다같이 노력해야 한다.
Abstract
In May 2025, Korea University (KU) School of Law commemorates its 120th anniversary. This paper extends the historical reflection initiated in prior research marking the University’s centennial (1905–2005), turning now to the subsequent two decades—2005 to 2025—to trace the trajectory of education, scholarship, and academic development in commercial law at Korea University. The period since 2005 has brought profound transformation and unprecedented challenges to Korean legal academia and legal education. The transition from an undergraduate, examination-based system of legal training to an American-style law school model fundamentally reshaped the institutional framework, leading to the abolition of traditional undergraduate legal education within colleges of law and the establishment of graduate-level professional law schools. Within this context of structural reform and intellectual reorientation, this study examines how commercial law at Korea University has responded to these changes. Over the past two decades, KU has remained steadfast in its commitment to cultivating the ideal of a whole person — one who combines intellectual depth with boldness of spirit. This vision has been pursued through consistent efforts at diversification and a vibrant culture of academic competition. Commercial law scholars at KU, including esteemed emeritus professors, have engaged in rigorous discourse on legal doctrines and interpretations, blending intense intellectual rivalry with a lasting sense of collegiality. As we reflect in 2025, we are reminded that today’s present soon becomes tomorrow’s history—and that history, in turn, shapes the path ahead. Thus, retrospection should not be merely commemorative, but strategic, offering critical insights into the future direction of commercial law scholarship at Korea University. Standing now at the threshold of a new century, we must rise to meet new challenges: moving beyond the passive reception of foreign legal theories toward cultivating a legal culture grounded in Korea’s lived realities and normative traditions. In this evolving legal and educational environment—particularly one increasingly focused on practice-oriented instruction—the role of foundational legal scholarship remains more essential than ever. As KU School of Law aspires to play a leading role in shaping the global legal order and contributing meaningfully to transnational legal discourse, commercial law must once again take the lead in charting a new course for the next hundred years.
