초록
사업자의 순차공개 가격책정(Drip pricing) 전략은 다크패턴(Dark pattern)중 한 유형으로 상품 검색 결과가 나타나는 첫 페이지에 의도적으로 가격을 낮게 표시하고, 결제가 진행 됨에 따라 숨겨진 비용을 차츰 공개하며 나중에 그 전체를 더한 금액을 최종 가격으로 청구하는 행위이다. 순차공개 가격책정은 주로 관광 관련 업종인 숙박업, 여행업, 또는 차량대여업이나 렌탈 서비스업 등에서 가격표시 전략으로 사용된다. 최근 전자상거래를 통한 구매가 급증하면서, 사업자가 숨겨진 수수료 등을 통해 순차공개 가격책정 행위를 악용하여 소비자에게 피해를 주는 사례가 증가하고 있다. 소비자가 광고된 가격을 보고 구매 절차를 진행하면, 결제단계에 이르러서야 필수적인 수수료 등이 포함된 전체 가격을 알게 된다는 점에서 소비자에게 가격 관련 정보를 첫 화면에서 제공하는 것이 중요하다. 우리나라는 순차공개 가격책정 관련 규제를 위한 관련 법률을 정비하고 있는 시점에서 해외 주요 나라의 법률과 사례를 검토하여 시사점을 얻을 수 있을 것으로 보인다. 본고에서는 순차공개 가격책정의 개념을 살펴보고, 순차공개 가격책정 행위와 관련한 해외 법률 및 사례를 검토한 다음, 이를 바탕으로 우리나라에서 순차공개 가격 책정 규제 관련 방안을 모색해 보고자 한다.
Abstract
Drip pricing is a type of dark pattern in which a business intentionally displays a low price on the first page of search results for a product, then gradually reveals hidden costs as the customer proceeds to checkout and charges the full amount as the final price. It's a pricing tactic often used in tourism-related industries, such as hospitality, travel, or car rental and leasing services. With the recent surge in e-commerce purchases, there have been an increasing number of cases where businesses have abused the practice of drip pricing through hidden fees and other tactics that harm consumers. It is important to provide consumers with price-related information on the first screen because once a consumer sees the advertised price and proceeds with the purchase process, it is only at the checkout stage that the full price, including mandatory fees, is revealed. As Korea is developing laws to regulate drip pricing, it is useful to review the laws and practices of other countries to gain insights. In this article, I will introduce the concept of drip pricing, review foreign laws and cases related to drip pricing practices, and explore ways to regulate drip pricing in Korea.
