WHO European(2011) 접근방식을 중심으로 한 피해장애아동 보호 관련 법률 분석 및 개선방안

The purpose of this study is to compare and analyze laws related to the protection of victimized children with disabilities, identify the current status and challenges of the child abuse response system for children with disabilities, and explore alternatives for improvement. The scope of the study was limited to the Welfare of Persons with Disabilities Act, the Child Welfare Act, and the Act on Special Cases Concerning the Punishment of Child Abuse Crimes. Using the WHO European(2011) analytical framework, the study classified the content into selective and target-specific approaches for analysis. The selective approach focused on key concepts, reporting and reception, on-site response, and investigation. The target-specific approach analyzed emergency protection measures, the establishment of protection plans and victim support, and follow-up management. The analysis revealed that the definitions of key concepts such as disability, child, and abuse differed across the laws. It was also found that the abuse response system—covering reporting, on-site investigation, and victim support—varied depending on how victimized children with disabilities were defined.
