중국의 기업데이터 지식재산 보호 방안에 관한 고찰

초록
데이터는 혁신적 생산요소로서 경제와 사회 발전에 심각한 영향을 미치고 있다. 2021년 중국 데이터 거래 시장 규모는 463억(약 8조 7000억 원) 위안에 달하여 급속한 성장 추세를 보였다. 중국은 2017년 6월 1일부터 시행된 <사이버보안법>(網絡安全法)과 2021년 6월에 시행된 <데이터안전법>(數據安全法) 그리고 2021년 11월 1일부터 시행된 <개인정보보호법>(個人信息保護法) 등으로 대표되는 데이터 보호 관련 법률규정을 발행하였으며, 공법과 사법을 결합한 데이터 법체계를 형성하였다. 하지만 기업데이터의 권익 보호 차원에서는 아직 체계적인 법률규정이 형성되지 않았다. 따라서 사법 실천에서 판사들은 데이터 시장 경쟁행위에 대한 <부정경쟁방지법>의 일반 조항의 법적 규정을 바탕으로 기업데이터 권익의 법적 보호를 간접적으로만 수행할 수 있다. 따라서 중국 기업데이터 지식재산 보호를 위한 법체계 구축을 실현하기 위해서는 먼저 기업데이터 본체에서 출발하여 지식재산권 이론 구조와의 적합성을 탐구하고 기업데이터 지식재산 보호의 합리성과 가능성을 명확히 해야 한다. 그리고 지식재산권 제도의 기본구조에서 출발하여 현재 중국 기업데이터 지식재산 보호에 문제를 정리하면서 전문적인 기업데이터 지식재산 보호 방안의 구축 경로를 살펴본다.
Abstract
As an innovative factor of production, data is having a profound impact on economic and social development. In 2021, China's data trading market size reached 46.3 billion yuan (about 8.7 trillion won), showing a rapid growth trend. China has issued data protection-related laws and regulations represented by the Cybersecurity Law, which took effect on June 1, 2017, the Data Safety Law, which took effect in June 2021, and the Personal Information Protection Law, which took effect on November 1, 2021, forming a data legal system that combines public and private law. However, in terms of protecting the rights and interests of corporate data, no systematic legal regulations have yet been formed. Therefore, in judicial practice, judges can only indirectly protect corporate data rights and interests based on the legal provisions of the general provisions of the Unfair Competition Prevention Act on data market competition. Therefore, in order to realize the construction of a legal framework for the protection of corporate data intellectual property in China, we must first start from the main body of corporate data, explore its conformity with the theoretical structure of intellectual property rights, and clarify the rationality and feasibility of corporate data intellectual property protection. Then, starting from the basic structure of the intellectual property system, we will summarize the current problems in China's enterprise data intellectual property protection and explore the path of establishing a professional enterprise data intellectual property protection scheme.
